Mayor Warkentien: It would be financed by assessment. <br />Mr. McCleary: I am assuming you are talking about punting in catch basins <br />on the south side of Roselawn. <br />286? <br />Engineer Lemberg: The ~.tean ate proposal was this at the last meeting and still <br />having the right in the future to tie 3.n. The assessment is <br />not based on arm engineering data. The normal assessment based <br />on r`un-off formula and entire area would cost about $1,200 per <br />lot.. But we refused this offer. The Village can divide this <br />$350 up. <br />Richard Bandon: Last meeting we talked about engineering aspects and was <br />there a legal right to have drainage through this area? <br />Attorney Seed: The straight answer is the law does not help you. If it <br />could be shown that the natural flowage of water was to the <br />north and that the water did flow to the north and did not <br />collect and if it could be shown that prior to the area <br />being developed, the water didn't collect to the area south <br />of the line, then there would be a legal case. The difficulty <br />is establishing, historically, water flowage to the north. <br />Most, if not all, of the water did collect in ponding areas <br />south of Roselawn. The real issue is this fact question. <br />It doesn't look too promising for the residents south of Roselawn. <br />Mr. Joyce: The County would have maps showing the prior collection of water. <br />Engineer Lemberg: Some of the areas were filled as much as three feet. <br />Mr. Blumfield After that pond is drained and dry, the construction company <br />1900 Tatum: intends to build. Th at means that Roseville would get the <br />tax base; they just want us to pay; it's not going to benefit <br />r~'alcon Beights. It rains so hard sometimes that no storm sewer <br />would take it. Tatum Street has never been in better shape <br />than it is today. I think that the water from Roselawn runs <br />north . <br />Engineer Lemberg: The other day I was out there. If flows in both directions; it <br />Tits right in front of your driveway. I explained at the hearing <br />that each lot would be cheked and those not contributing would not be <br />assessed. The policy established is the direction it roans <br />off the flow of the lot determines the district the lot will be in. <br />I am not going to go into this. <br />Attorney Seed: This is a very acceptable way of assessing. <br />Engineer Lemberg: If we include those two lots on the corner of Summer and Prior, <br />we pay $700 more. <br />Mrs . I~.rd : If tY~ey are contriibuting water, then they should be paying . <br />Engineer Leamb erg: They are paying for the south district when it comes in.
