23ts6 <br />made by :Art Lindig on the 23rd day of February 1966 for use <br />of that property described as Lot 1, Block 1, Lindig First <br />Addition located north of and adjacent to Lindig's Greenhouse <br />at 1875 West Larpenteur Avenue which property is presently <br />zoned as R-3, all under the provisions of Sec. 16.05, Ordinance <br />No. 64 of the Village of Falcon Heights for the reason followings <br />1. Said variance is not in harmony with the general <br />purpose and intent of the Ordinance and comprehensive plan of <br />the Village of Falcon Heights. <br />Motion was duly seconded by Stone and upon a vote being taken, <br />the following voted for sames Nilsen , Black, Warkentien and <br />Stone and the following voted against sames None. Whereupon <br />said resolution was adopted by the Council.. <br />Damage to Police Council was advised that minor claim against Standard Oil <br />Car by employee Station at 1697 North Snelling Avenue was denied by insurance <br />of Standard Oil carrier, therefore, damages amounting to X21.11 on the Village <br />Stations police car remain unpaid. Warkentien was requested to contact <br />Garnet Gallimore, manager of said station, in an effort to <br />settle. <br />Dog Control It was moved by Black, seconded by Warkentien that the Village <br />Resolutions Council adopt the following resolution regarding the keeping <br />of dogs within the Village of Falcon Heights <br />WHEREAS, the Village of Falcon Heights has adopted an <br />ordinance Registering and Regulating the Keeping of Dogs in <br />said Village, being Ordinance No. 39, adopted April 11, 1956, <br />and <br />WHEREAS, under the provisions of Section 1!~ of said <br />Ordinance, the Falcon Heights Village Council is authorized to <br />enact a resolution prohibiting, for a given time, any and all <br />dogs from running at large in said Village, <br />NOw, THEREFORE, BE IT RESOLVED that any and all dogs are <br />prohibited from running at large in the Village of Falcon <br />Heights from April 1st to September 30th, 1966 inclusive. <br />A dog is deemed "at large" whenever it is off the property <br />of his owner or keeper and not under restraint. Such dog shall <br />be deemed under restraint only when it i~ controlled by a leash <br />not exceeding 6 feet in length, or it is at "heel" beside a <br />competent person having custody of him and obedient to that <br />person's commands, or within a vehicle being driven or pushed <br />on a public street or within the property limits of his owner's <br />premises. An unattended dog on the property of another, without <br />the consent of such property owner is "at large" and not under <br />restraint even though he is on a leash. <br />Upon a vote being taken, the following voted in favor of sames <br />Nilsen, Stone, Warkentien and Black and the following voted <br />against same: None. Motion was carried. <br />
