17l~0 <br />Sewer Stubs It was moved by Stone, seconded by Mortenson and voted to <br />damaged by approve the following resolutions <br />Herbst: <br />WHEREAS, the Village of Falcon Heights has previously commenced <br />a law suit in District Court in and for Ramsey County against <br />Herbst Construction Company, 8180 Eastwood Drive, Minneapolis, <br />21, Minnesota for alleged damage to it's Sanitary Sewer System <br />by disrupting such sanitary sewer system by cutting a sewer line, <br />and <br />WHEREAS, the Herbst Construction Company have offered the sum <br />of X1500.00 {fifteen hundred dollars) as a compromise settlement <br />- of the claim of the Village of Falcon Heights, axed <br />WHEREAS, upon the full review of all financial records and in- <br />formation, the Village of Falcon Heights damages are limited to <br />to approximately $1500,00 (fifteen hundred dollars) <br />NG~V' THEREFORE, BE IT RESOLVED that said claim against Herbst <br />Construction Company be fully settled upon payment of the <br />Maryland Casualty Company of the sum of X61500.00 (fifteen hundred <br />dollars), and that the Mayor and the Clerk be authorized and <br />hereby directed to execute such releases, dismissals and any <br />other documents necessary to compromise such claim, and the <br />Village Attorney is hereby directed to dismiss said claim upon <br />payment of said X1500.00 {fifteen hundred dollars}. <br />It was moved by Stone, seconded by Warkentien and voted to <br />accept the X1500.00 (fifteen-hundred-dollar) check from Maryland <br />Casualty Company, to deposit same in the General Fund, and that <br />4k1000.00 {one thousand dollars) of the funds still remaining in <br />the Larpenteur Avenue Waterma~,n & Pumping Station Construction <br />Fund be released to Herbst Construction Company. <br />Traffic Lemberg suggested that Al Helbig take care of the Traffic Counters. <br />Count: Lemberg will e~ive Helbig instructions. <br />Sinking Inventory of '3onds, Sills, and Notes held in safekeeping for the <br />Funds: various Si.nkingFunds was received from the First National <br />Bank. The Original copies were given to the Treasurer for con- <br />firmation, signature, and to be returned to the bank. The dupli- <br />cate copies to be filed in the Clerks office. <br />Police Car: Clerk Mortenson read Ad for bids as published in the Rose Tribune. <br />One bid was received from Midway Ford Company. The following reso- <br />lution was offered; <br />Pursuant to an advertisement for bids for the purchase of a 1962 <br />police car in accordance with the resolution adopted March 21, <br />1962, and pursuant to statuatory notice being published on r4arch <br />29, 1962, bids were received, opened and tabulated according to <br />law, and the following bid was received complying with the adver- <br />tisements <br />Midway Ford Company, 1850 University ?venue, St. Paul, I~, Minn., <br />
