The attorney will be asked to <br />redraft this portion for Council reivew on September 2~, 1986. <br />7:30 P.M. PUBLIC HEARING ON DELINQUENT SANITARY SEWER CHARGES <br />Baldwin opened the public hearing at 7:30 P.M. and presented the Affidavits of <br />Publication and Mailing. There being no one present wishing to be heard <br />Baldwin closed the hearing at 7:33 P.M. Ciernia moved, seconded by Chenoweth, <br />adoption of Resolution R-86-38 <br />RESOLUTION R-86-38 <br />A RESOLUTION LEVYING SPECIAL ASSESSMENTS FOR DELINQUENT <br />SANITARY SEWER CHARGES <br />PROPOSED SNELLING AVENUE RECONSTRUCTION UPDATE <br />Sehunicht presented the history of the proposed reconstruction of Snelling <br />Avenue, and reviewed the plans. He commented on the fact that six lots on the <br />west side of Snelling do not have city water, the owners were asked a few years <br />ago if they were interested in extension of the service in conjunction with <br />Snelling Avenue construction, but indicated they were not in favor of extension <br />at that time. He recommended the property owners again be contacted and <br />informed this will be the last opportunity for extension of the service. <br />Schunicht explained MN/DOT is considering a storm water pumping station at <br />Idaho/Snelling as was stipulated in an agreement with the City in 1960; <br />however, since the drainage problem has been minimized, there is no compelling <br />reason to install the pump. He felt it might be a good negotiating tool with <br />MN/DOT, the city will not press for the pumping station if the city is not <br />charged for storm sewer replacement. Council discussed at length the cost <br />sharing for storm sewer replacement, recalled MN/DOT had formerly stated the <br />cost to the city would be minimal and would not warrant an assessment, and now <br />the cost is estimated at $10,000 to $50,000. Council also felt the storm sewer <br />is in place and functioning and if MN/DOT desires replacement they should fund <br />it . <br />Council discussed the advantages of extending the water main at this time, the <br />need for a hydrant on the west side of Snelling for fire protection, and having <br />the service available if property owners might desire city water in the future. <br />Chenoweth suggested the main at least be brought across Snelling and a hydrant <br />installed during the street construction, after which Chenoweth moved, seconded <br />by Wallin, authorizing the engineer to prepare a feasibility study on the water <br />main extension, and requesting MN/DOT include the watermain in the Snelling <br />project as an alternate which could be deleted. Motion carried unanimously. <br />MN/DOT will be informed the city will compromise, will forego the pumping <br />station if MN/DOT will finance all or a majority of the cost of storm sewer. <br />ORDINANCE RELATING TO ASSESSMENT HARDSHIP DEFERRALS TO BE DRAFTED FOR REVIEW ON <br />9/2~-86 <br />Council reviewed model ordinances From other communities relating to hardship <br />deferrals and after a discussion directed staff to draft an ordinance based on <br />the one adopted by the City of Lexington with the following stipulations: <br />
