MINUTES <br />SEPTEMBER 27, 1989 <br />PAGE 2 <br />to be heard, the hearing was closed at 7:31 P.M. Ciernia, <br />moved, seconded by P. Chenoweth, adoption of Resolution <br />R-89-21. Motion carried unanimously. <br />RESOLUTION R-89-21 <br />A RESOLUTION RELATING TO LEVYING SPECIAL ASSESSMENTS <br />FOR DELINQUENT SEWER CHARGES <br />SMOKING POLICY DISCUSSION <br />Carol Carlson and Gail Smida, members of the Smoking Committee <br />presented the proposed policy for Council consideration. <br />Council expressed concern that the policy might not be in <br />compliance with State Statutes and felt a policy should not be <br />adopted if it did not comply. Smida explained that the Fire <br />Department policy was drafted based on the fact that the <br />Department is volunteer and the area is not in use much of the <br />time. She explained that the "sleeper" spends eight to ten <br />hours alone which would not affect others, and drill night is <br />about the only time when a large group is together. Following <br />the discussion Council requested that the policy be reviewed by <br />the City Attorney to determine whether or not it would be <br />acceptable according to State Law, and if it is permissible to <br />phase in a totally smoke free environment which is the intent. <br />1990 LAUDERDALE FIRE PROTECTION/PREVENTION CONTRACT <br />Wiessner explained that she had discussed the proposed contract <br />with Mayor Anderson of Lauderdale and that he understands the <br />need for the increase. Anderson had expressed concern regarding <br />the number of false alarms and wanted to design a method by <br />which those who create the false alarms could be discouraged. <br />Wiessner suggested it might be possible to eliminate the base <br />charge and increase the per call/per/truck hourly rate, which <br />Lauderdale collects from the person or firm creating the false <br />alarm, with the income for Falcon Heights remaining the same as <br />projected. Following a brief discussion, P. Chenoweth moved <br />that Wiessner be authorized to amend the contract using a method <br />which is agreeable to Lauderdale which would also maintain the <br />same projected income for Falcon Heights. Motion carried <br />unanimously. <br />STATE FAIR PARKING SIGNS -DISCUSSION <br />Carol Carlson and Vince Wright presented several alternatives to <br />the installation and removal of signs during the State Fair due <br />to concern expressed by the City's Workers Compensation <br />Insurance Company about the extent of lifting and pounding <br />required in the operation. The Public Works staff recommended <br />the use of permanent, year round sign similar to those used by <br />the City of St. Paul. Council concurred that experimenting with <br />reducing the number of signs by eliminating posting in areas <br />where it may no longer be necessary might help remedy the <br />problem.
