~~~ <br />Douglas Rees B6r. Rees asked t o be heard and said that instead of a <br />hearing he wished we were talking informally. Stated he <br />has owned the property 14 years that is on the alley it <br />is proposed to close. That the condition of the present <br />alley is the result of a com®dy of errors. :ties tried <br />hard to work out the problem of alleys. Does not want <br />trucks in front of buildings which may be put up on Lots <br />4 and 5. Said he would willingly give letter stating he <br />would never ask to vacate the east and west alley. Said <br />he had recently told Engineer Carley he hated to see the <br />proposed alley opened, that he never wanted it opened and <br />never wants driveway to Crawford, depending on what can be <br />done abcu t the setback . <br />Ira Karon in rebuttal stated that granting of the petition will add <br />attorney 10 feet to Rees' property. ~s to sufficiency of petition, <br />said the statute (which he read) is very clear. ~s to alley <br />serving as a buffer, said it would be extending commercial <br />operations right into the residential area. As to making <br />a one-way alley so that trucks will only come in off Snelling <br />and not thru the Crawford residential area; this, he said, <br />would not cut down on the number of trucks, and said that <br />placing restrictions on trucks using certain streets would <br />be invalid. Said the public interest means a sufficient <br />number of people are involved to exceed the interests of an <br />individual. Opening of the proposed alley may also create <br />problems in various other parts of the Village, Mr. Karon <br />said. Mr. Karon presented snap shots with respect to drain- <br />age; and debris in the existing alley and indicated similar <br />conditions might prevail in the proposed alley if opened. <br />John G. Bouthilet in rebuttal said he would like to point out a few things. <br />®ttorney As to Mr. Karon's suggestion that if vacation of the alley <br />is granted there would still be sufficient room to serve <br />Mr. Rees' property on Lots 4 and 5; Bouthilet said th ere <br />would not be room for backing up trailer trucks or post <br />office trucks, the latter requiring a 14 ft. drive. 6s to <br />public interest; Mr. Bouthilet said it does concern the <br />public who will patronize a post office as to the amount <br />of traffic going from Snelling to the proposed alley, a <br />distance of 150 feet. <br />Hearing adjourned No one else wis king to be heard, t~cting ~dayor Shavor <br />declared the hearing closed at 10 P.9Q., stating that the <br />council would take the matter under advisement and endeavor <br />to reach a decision at their next regular meeting. <br />Meeting resumed. Rbgular meeting was resumed and conducting of same was <br />taken over by Mayor Henry who arrived at this time. <br />. 7-alley impvt. Engineer Carley's letter of Sept ember 11, with partial <br />payts. estimate No. 2 for Gust ~. Holm Construction Co., for <br />?-alley improvement work, amounting to $8,514.72, and <br />letter and statement of September 11, 1952, covering <br />partial payment for engineering services by Mr. Carley, <br />amounting to X750.00, was considered. Rekstad moved <br />payment, Stewart seconded and motion carried unanimously. <br />
