The commission discussed the eight uses and <br />requested staff to further research on: <br />• What impacts might result from the inclusion of these uses in the <br />city's Snelling and Larpenteur Commercial District? <br />• What characteristics make .Falcon Heights's unique for regulating <br />commercial zoning uses? <br />• How the neighboring cities of Roseville and St. Paul regulate these <br />uses? <br />II. KEY POINTS ON DECIDING HOW TO PROCEED <br />Staff met with the Peter Bachman, the city attorney, to further define what <br />options are legally available and reasonable for the city to pursue in <br />controlling these uses. Although this information may not be new to you, it <br />is useful to summarize it. <br />A. Under its statuatory police powers the city has the authority to adopt <br />ordinances, including land use ordinances that protect the health <br />safety and public welfare A use may be controlled bv• <br />• zoning -permitting it or not permitting a use in a zoning district <br />• zoning with conditions on where, when and how a use <br />operates <br />• licensing requirements <br />• a combination of zoning and licensing <br />B. Under Section 9.201 Subd 3 in the citv's zoning code if a use is not <br />listed as a oermitted or conditional use in the district it is not allowed <br />in the city. <br />The council may pass a resolution finding that a use that is not <br />specifically listed in the zoning code is similar to those uses that are <br />listed, and therefore, should be allowed. <br />C. A challenge may result from not including a use if the use is deemed <br />similar to anther use that is listed as a oermitted or conditional use in <br />the zoning district <br />• Therefore, the commission must review the current list of permitted <br />and conditional uses to make sure that they clearly identify uses that <br />create the desired business environment in the Snelling and <br />
