In order to be able to <br />control "chronic" garage sales with merchandise brought onto the <br />property from outside the home and neighborhood, the following <br />additions to the code are intended to regulate flagrant abusers <br />of garage sales. They are not intended as a mechanism to <br />discourage annual residential garage and boutique sales held by <br />homeowners and their neighbors or to eliminate moving sales or <br />estate sales. <br />9-4.01 Subdivision 3 Permitted Accessory Uses <br />(1) Garage and residential boutique sales limited to one sale <br />each calendar year per residential unit, not to exceed ten <br />consecutive days or two consecutive weekends (proposed <br />10/22/90). <br />• 9-1.02 Rules and Definitions <br />132 (proposed) Sale - Garage <br />A garage sale is a sale of used household and personal items <br />conducted on residential premises, where the property sold <br />consists of items owned by the occupant or the premises at <br />which the sale takes place, or by friends of such occupant, <br />and where the sale is conducted by such occupant or friends. <br />Items for sale shall not have been purchased for resale or <br />received on consignment for the purpose of resale. (proposed <br />10/22/90) <br />133 (proposed) Sale - Residential Boutique <br />A residential boutique sale is the sale of handcrafted items <br />conducted on residential premises, where the items sold are <br />made by the occupant of the premises at which the sale takes <br />place, or by friends of such occupant, and where the sale is <br />conducted by said occupant or friends of such occupant. <br />Items for sale shall be made in the home and not purchased <br />for resale from any retail or wholesale business source nor <br />received on consignment for the purpose of resale. <br />(proposed 10/22/90) <br />.
