underscored in Section 6 "R-1",.One Family Residenital District and Section <br />3 - Rules and Regulations which follows: <br /> <br />6.4 (2) Aside yard abutting a street shall not be less than thirty <br />(30) feet in width. <br />3.1 (3) The word "shall" is mandatory, and the word "may" is permissive. <br />A yard shall extend along a lot line and at right angles to such lot line <br />to a depth or width specified in the yard regulations for-the district in <br />which such lot is located. A yard shall be measured from the lot line to <br />the vertical wall of the principal structure or structures. <br />,,. 3.2 (67) Yard-Side - A yard extending along the side lot line between the <br />front and rear yards having a width as specified in the yard regu- <br />lations for the district in which such lot is located. <br />4.1 (1) In their interpretation and application, the provisions of this <br />Ordinance shall be held to be the minimum requirements for the <br />promotion of the public health, safety, morals and welfare. <br /> <br />WHEREAS, the preliminary development plan sheet No. P-5 Issue date 18 <br />January, 1982, Print date 21 January, 1982 showing the projection of proposed <br />Prior Avenue northward from Larpenteur Avenue into a proposed east-west street <br />culminating in a cul-de-sac on the eastern terminus bounded by single family <br />lots and exiting to the west with a present terminus at the city park but with <br />a proposed extension of the east-west street through the city park to Cleveland <br />Avenue results in a good plan with one exception, the proposed extension of <br />Prior Avenue through Falcon-Woods for general public traffic with the same <br />devestating effect as previously stated and, <br />WHEREAS, the Planning Commission of the City of Falcon Heights recommends <br />that the street northward from the propossdeast-west street to Summer Street <br />in Falcon Woods be designated for vehicular traffic use of an emergency nature- <br />such as police, fire, rescue squads, public service, etc., and that appropriate <br />and wed.lconceived measures be taken to assure this. <br />NOW THEREFORE, the Planning Commission of the .City of Falcon Heights <br />recommends to the City Council of Falcon Heights the acceptance of the pro- <br />posed preliminary street plan as identified by sheet No. P-5, Issue date 18 <br />January, 1982, Print date 21 January, 1982 as prepared by Harold J. Westin <br />and Associates for the American Shelter Corporation with restrictions as <br />included in the resolution, that one or possibly two traffic circles be <br />placed on Prior Avenue at strategic location (s) and that the Planning <br />Commission realizes the necessity and importance of traffic signals at <br />Larpenteur and Prior and recommends such installation. <br />The motion for the adoption of the foregoing Resolution-was duly <br />seconded by Commission Member Labalestra and upon a vote being taken <br />thereon, the following voted in favor thereof: Olson, Nilsen, Blomberg, <br />Labalestra, Stefanson, Mead and Waldo, and the following voted against the <br />same: Wallin. <br />WHEREUPON, said resolution was <br />• <br />ATTEST: . <br />G r ld Wallin, Secretary <br />declared duly passed and adopted. <br />Alan.Stefanson, airman <br />
