of Crystal (municipal dedication requirement); and Potts v. City of Hugo (interpretation
of municipal zoning ordinance).
(4) MSA 429 Projects
The firm has been involved in a number of appeals of special assessments. While
this is not a mainstay of our practice, we are very familiar with all of the legal principles
pertaining to "benefited property" as well as the procedures for proposed assessments,
public hearings and appeals and are well suited to represent the City in this area.
(5) Environmental and Superfund Law
LS &D has one of the larger environmental practices in the state of Minnesota.
The firm has regular dealings with the Minnesota Pollution Control Agency "PCA and
the United States Environmental Protection Agency "EPA on a full range of
environmental issues.
In the Superfund area, LS &D has represented a number of businesses in superfund
investigations, lawsuits, settlements, and property cleanups. During the course of this
representation, we have hired and managed environmental consultants, worked with
generator groups and negotiated with governmental entities.
Other areas of environmental law our lawyers handle on a regular basis include
underground storage tanks, environmental criminal law and compliance, environmental
legislation and rule making, pre- purchase investigations, environmental assessment
worksheet and environmental impact statement compliance, wetlands issues, metropolitan
significance proceedings, and solid waste and resource recovery issues.
The firm is also proud of its commitment to public interest and public service in
the environmental field. Firm attorneys were founders of the Minnesota Public Interest
Research Group "MPIRG and counsel for the Sierra Club and have drafted many of
the state's key environmental laws, served on the board of the PCA, the Minnesota
Hazardous Substance Injury Compensation Board, the Minnesota Environmental Quality
Board, the Project Environment Foundation and the Minneapolis Environmental
Commission, and have served as chief counsel for the Minnesota Pollution Control
Agency.
c. Employment Law
LS &D's employment law department consists of 10 attorneys practicing full time
in the area of employment law. The firm is nationally recognized for its employment law
expertise and has represented numerous clients, both large and small, in public and
private employment matters. For example, we have represented the University of
Minnesota in three class action cases claiming discrimination in faculty appointments,
student aid and athletic scholarships. In addition, the firm litigated over 50 claims made
by female faculty members at the University of Minnesota in connection with the 1980
Rajender consent decree.
5
