V. Conflict of Interest
A. Indicate whether you or your law firm represent, or have represented, any
client which representation may conflict with your ability to serve as City
Attorney.
We represent no client which would conflict with our ability to serve as City
Attorney. We do represent Amoco Oil Company on an on -going basis with respect to
zoning and land use matters in the metropolitan area. If any potential conflict arose, we
would not represent Amoco in its dealings with the City.
B. Do you currently represent any real estate developers?
We currently represent several real estate developers; however, we are aware of
no plans for any proposed developments in the City of Falcon Heights. Again, if any
potential conflict arose, we would represent the City in such matter.
C. Do you currently represent any other local units of government having
jurisdiction within, or contiguous to the City of Falcon Heights?
No.
D. What procedures does your firm utilize to identify and resolve conflicts of
interest?
The firm has extremely efficient, mandatory procedures for the identification of
conflicts of interest prior to taking on new matters. Before any new matter is taken on,
a conflict of interest form is circulated to all attorneys in the firm and the firm
undertakes a computerized conflict review covering all active matters. This ensures
potential conflicts of interest are fully identified and resolved prior to commencing new
representation. The firm prides itself on having the highest of ethical standards and is
meticulous in its adherence to the Minnesota Rules of Professional Conduct.
VI. Contract Ethics
The firm will comply with all ethical considerations raised in the RFP. In
particular, the firm hereby certifies that it will not discriminate under the contract for
legal services with the City against any person in accordance with federal, state or local
regulation.
PHB \MKTG \FALCON.RSP 16
