The maximum fence height in <br /> side and rear yards is six feet. The Kings say they need an <br /> eight foot fence because of the neighbor's garage at 1433 West <br /> Idaho, which was granted variances to allow its completion at 988 <br /> square feet. The city approved a building permit for the <br /> garage's construction prior to the variances being granted. <br /> Because of the city error at 1433 West Idaho, which the Kings' <br /> perceive as creating a need for an eight foot fence, Mr. and Mrs. <br /> King would like to be exempt from the $45 fee for a variance <br /> request and the $50 building permit fee for the fence. The staff <br /> has not processed the King's variance request because the fee is <br /> charged to cover these costs. The variance will be processed and <br /> reviewed by the planning commission after the fee is either paid <br /> by the Kings or waived by the council. <br /> In the past the city has not allowed exemptions to the city's fee <br /> structure. Any exemption would be a departure from past policy. <br /> ATTACHMENT: <br /> A Letter from Mr. and Mrs. King, dated 2 February 1993 <br /> ACTION REQUESTED: Deny the request for waiving the fee for a <br /> variance request and building permit. <br />
