Meeting Date: 6/23/93 <br /> Agenda Item: P 2 <br /> CITY OF FALCON HEIGHTS <br /> REQUEST FOR COUNCIL CONSIDERATION <br /> ITEM DESCRIPTION: Proposed amendment to the commercial district <br /> development moratorium ordinance, Chapter 5 <br /> Section 5 Subdivision 3 (c) <br /> SUBMITTED BY: Planning Commission <br /> REVIEWED BY: Susan Hoyt, City Administrator <br /> Peter Bachman, City Attorney <br /> Fred Hoisington <br /> Planning Commission <br /> EXPLANATION /SUMMARY: As the staff and consultant proceeded with <br /> the commercial zoning study begun last fall, it became clear that <br /> there are several commercial uses that cannot be easily included <br /> or excluded from the city's proposed Snelling and Larpenteur <br /> commercial district without determining the statutory authority <br /> the city has over certain uses, the possible secondary impacts of <br /> certain uses and the best way to control certain uses (i.e. <br /> zoning, conditions, licensing). Although the development <br /> moratorium on the city's commercial districts currently restricts <br /> most of these uses from the city because they are not <br /> specifically listed permitted uses in the city's zones, the <br /> moratorium will be more effective if these uses are specifically <br /> identified for two reasons. First, it will clarify any possible <br /> ambiguities in what uses fall under the moratorium. Second, it <br /> will allow the city to remove most of the commercial uses from <br /> the development moratorium when the first phase of the zoning <br /> study is done and leave the more complex uses under the <br /> moratorium until the best way to regulate them is determined. <br /> The proposed list of these items does not mean that the city will <br /> or will not choose to exclude them from the final commercial <br /> zoning code. These uses appear because they may have secondary <br /> impacts on the city's business and residential neighborhoods and, <br /> therefore, require new or changes in conditions on the uses or <br /> new licensing requirements. Some uses may be excluded. <br /> The planning commission recommended the proposed ordinance change <br /> at its June 7, 1993 special meeting. <br /> ATTACHMENTS: <br /> A Proposed amendment to the ordinance on the development <br /> moratorium.
