A <br /> INDEPENDENT SCHOOL DISTRICT NO. 623 <br /> SCHOOL BOARD RESOLUTION <br /> WHEREAS, Independent School District No. 623 (the "School <br /> District desires to work cooperatively with the City of Falcon <br /> Heights (the "City to finance and construct certain street, storm <br /> sewer and parking improvements on property at and adjacent to the <br /> Falcon Heights Elementary School located at 1393 West Garden <br /> Avenue, Falcon Heights, Minnesota (the "Improvements and <br /> WHEREAS, the School District has requested the City to finance <br /> a portion of the costs of the Improvements by special assessment <br /> pursuant to Minnesota Statutes Chapter 429; and <br /> WHEREAS, the City has informally indicated its willingness to <br /> cooperate with the School District to finance the Improvements <br /> through a special assessment against School District property, <br /> provided all statutory requirements are met and the School District <br /> agrees to enter a cooperative agreement embodying the terms and <br /> provisions deemed necessary by the City to fully protect the City's <br /> interests. <br /> NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br /> 1. The School District hereby petitions the City pursuant <br /> to Minn. Stat. 429.031, subd. 3, for improvements to <br /> PHB \FALCON \SB- RES.001 DRAFT 01/27/94 3:Olpm <br />
