The Planner <br />noted that the house immediately west of the Whitman property has a deck <br />that overlooks the Whitman's patio and spa area. Therefore, Whitman is <br />requesting the CUP for the 8-foot high fence to provide some additional <br />privacy for this area. <br />Mario Mariani, 335 Rose Lane, indicated that his property is immediately <br />west of the Whitman property. He asked the style of the proposed fence. <br />The City Planner indicated that it appears the fence will be of wood <br />construction. He also noted that the finished side of the fence will have to <br />face outward, Coward the neighboring properties. <br />Mariani noted that there is a jog in the property line between his property <br />and the Whitman property. If a portion of the fence is going to be up to <br />the property line, Mariani asked how the City verifies that the fence is <br />constructed in the proper location. The City Planner reported that Mr. <br />Whitman will have to prove to the Building Official that the fence is being <br />installed in Che proper location. If necessary, the Building Official can <br />require a survey of the property. <br />Barraclough asked about the height variations in the fence. The City <br />Planner again noted that in front of the house structure, fencing of 4 feet in <br />height is allowed. Along side the house and into the rear yard, the Code <br />allows fencing of 6'/z feet in height. Whitman is requesting a CUP to go <br />to 8 feet in height along side his patio/spa area. The Planner indicated that <br />when he first met with Mr. Whitman, he mistakenly told him that 8 feet in <br />height would be allowed as long as the fence was at the minimum side <br />yard setback line which is 7'/z feet. Once this error was pointed out, <br />Whitman opted to pursue the CUP option for the 8 foot fence height. <br />Knudsen asked about materials. The Planner noted that all the fencing <br />along the western property line is proposed to be wood fencing. The <br />fencing along the north side of the patio/spa area is proposed as wrought <br />iron. <br />Mariani asked if a gate was proposed in the fence. The City Planner noted <br />that there is a gate proposed in the portion of the fence that jogs in at the <br />back of the house. The gate will face north. <br />Mariani expressed concern about the heater and pump that was just <br />installed for the spa. This equipment is outside the fenced-in area. <br />Mariani felt Chat the equipment should be enclosed for safety reasons <br />noting that there are a lot of children in the area. <br />-2- <br />
