MINUTES <br />CITY COUNCIL <br />JANUARY 2G, 2005 <br />The foregoing resolution was duly seconded by Montow~. <br />Ayes (5) LaValle, M.outour, Blesener, I{eis, Allan. <br />Nays (0). Resolution declared adopted. <br />PUBLIC Mayor Blesener opened the Public Hearing to consider an amendment <br />HEARING - to the Subdivision Ordinance establishing pipeline setback requirements <br />PIPELINE for new subdivisions. The Planning Commission has recommended <br />ORDINANCE approval of the amendment. <br />The City Planner reported that the proposed amendment imposes a <br />required setback for the buildable area of a lot from any pipeline easement <br />that is either on a property or adjacent to it. The Planner noted that this <br />requirement impacts new subdivisions, and would not impact existing lots <br />of record. <br />Blesener asked about the impact to a property owner wishing to add ou to <br />a house. T'he Planner again stated that the proposed ordinance only <br />impacts new subdivision and not existing lots of record. Blesener asked <br />how much propei~Cy is left in Little Canada that is large enough that it <br />could be developed as a subdivision. The Planner felt that there were only <br />a handful of properties large enough to be developed as a subdivision. <br />The Planner noted that the proposed ordinance amendment takes the <br />City's Pipeline Policy and puts it into ordinance form. <br />There was no one from the general public present wishing to comment on <br />this matter. <br />Upon motion by LaValle, seconded by Montour, the public hearing was <br />closed. <br />Ms. Allan introduced the following ordinance and moved its adoption: <br />ORDINANCE NO. 587 - AN ORDINANCE AMENDING CHAPTI?12S <br />I003.O,I0 AND 7006.020 OF TIIE LITTLE CANADA CITY CODE, <br />KNOWN AST]IESU73DIVISIONORDINANCE, 133'PIZOVIDING <br />FOR RESTRICTIONS ON THE SDI3DIVLSION 01~ NE1~VL OTS <br />LOCATED NEAR I'ETROT EUM PIPIiLINE.S <br />The foregoing ordinance was duly seconded by LaValle. <br />Ayes (5) Allan, LaValle, Montour, Blesener, Keis. <br />Nays (0).
