MINUTES <br />CITY COUNCIL <br />JULY 27, 2005 <br />would be less than $400,000 Chus returning some of the escrow dollars Co <br />Che Guerin Family. <br />Dave Guerin reported Chat it is his family's interpretation that the <br />Settlement Agreement requires that the Guerin escrow account be used <br />only after all other sources of clean up funds are exhausted. Guerin noted <br />that his family has $200,000 in escrow for the clean up, and if the State's <br />DEED grant is used first, along with County grant dollars if approved by <br />the County Board, there would be funds returned to the Guerin Family. <br />The City Administrator disagreed with Mr. Guerin's interpretation of the <br />Settlement Agreement, but again offered to meet with the State to push for <br />the use of State grant dollars before Guerin escrow dollars. The City <br />ACCorney agreed with the City Administrator's interpretation of the <br />Settlement Agreement. <br />Guerin indicated that based on their interpretation of the Settlement <br />Agreement, if Che Guerin escrow dollars are used first, the matter will end <br />up back in the courts. <br />The Council indicated that they had no objection to the City Administrator <br />meeting with Che State to push for the use of DEED grant dollars prior to <br />the use of Guerin escrow funds. However, the Council agreed with the <br />City Attorney's and CiCy Administrator's interpretation of the Settlement <br />Agreement. <br />Mr. LaValle introduced Che following resolution and moved its adoption: <br />RESOLUTION NO.2005-7-I68 -APPROVING THE STATE OF <br />MINNESOTA DEED GRANT AGREEMENT RELATIVE TO <br />ENVIRONMENTAL CLEAN-UP OF THE FORMER GUERIN <br />PROPERTY, AND AUTHORIZING THE MAYOR AND CITY <br />ADMINISTRATOR TO EXECUTE ON BEHALF OF THE CITY <br />The foregoing resolution was duly seconded by Keis. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />COMMUNITY The City Adminish~ator reported that he has not yet obtained the proposal <br />SURVEY from Decision Resources for a community survey. That proposal will be <br />presented to the Council at a future meeting. <br />
