MINUTES <br />CITY COUNCIL <br />AUGUST 24, 2005 <br />Blesener suggested that the City proceed with an offer of just <br />compensation, and in the meantime, staff could work with McGough on <br />alternative sites. <br />The City ACCOrney indicated that if the City is interested in acquiring Che <br />McGough site, the Council should authorize him to commence the process <br />as established under the Uniform Relocation Act. <br />Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION NO.2005-8-793 -AUTHORIZING THE CITY <br />ATTORNEY AND CITY ADMINISTRATOR TO BEGIN THE <br />PROCESS TO ACQUIRE THE MAC PROPERTIES SITE ON <br />WOODLYN AVENUE UTILIZING THE PROCESS AS SET FORTH <br />UNDER THE UNIFORM RELOCATION ACT <br />The foregoing resolution was duly seconded by Keis. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />CONTAMI- The City Attorney noted correspondence from the Guerin Family's <br />NATION attorney as well as his office relative to the disbursement of Guerin <br />CLEAN-UP/ settlement Funds as the first source of money used for clean-up of <br />GUERIN Che northeast corner of Rice Street and Little Canada Road. The Attorney <br />SETTLEMENT noted that unless the State and the County change the terms of their <br />AGREEMENT grant agreements, it is their position that any funds stipulated for clean-up <br /> be used prior to the utilization of grant dollars. <br />The City Administator reviewed a proposed resolution in the Council <br />packets which requests that the State DEED grant be amended whereby <br />Guerin restricted funds would become the second source of funding <br />toward clean-up costs thus making the State grant dollars primacy. The <br />Administrator noted, however, that based on conversations with the DEED <br />office, he is not hopeful Chat the State will approve this request. <br />Dave Guerin reported that he spoke with Mr. Murphy of the DEED office <br />who indicated Co him that it is up to the City as to which funds are utilized <br />first. Guerin reported that Mr. Murphy has indicated that the State will <br />reverse its position upon receipC of this resolution. The City Administrator <br />indicated that he was informed otherwise by the State. <br />Blesener indicated that the City had no problem requesting that the State <br />utilize its grant money as the primary source of funding for the clean up. <br />16 <br />
