MINUTES <br />CITY COUNCIL <br />AUGUST 24, 2005 <br />REZONING <br />& CUP - <br />151 COUNTY <br />ROAD B-2 <br />EAST <br />INDIAN LAND <br />TENURE <br />FOUNDATION <br />Upon motion by LaValle, seconded by Allan, the public hearing was <br />closed. <br />Mr. LaValle introduced the following resolution and moved its adoption: <br />RESOLUTION NO.2005-8-184 -APPROVING THE CONDITIONAL <br />USE PERMIT FOR ANATTACHED GARAGE OF 1,224 SQUARE <br />FEET AT 785 ALLEN AVENUE AS REQUESTED BY AMY INMAN <br />SUBJECT TO COMPLIANCE WITH THE RECOMMENDATIONS <br />OF THE CITY PLANNER AND THE PLANNING COMM75SION <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />The Mayor opened the public hearing to consider the Rezoning of <br />151 County Road B-2 East from High Density Residential (R-3) to <br />Residential-Business (R-B) to allow an office space addition to an existing <br />building and a Conditional Use Permit to allow a professional office use in <br />the RB District. It was noted that both the City Planner and the Planning <br />Commission have recommended approval of the Rezoning and CUP. <br />Randy Newberg, Rust Architects, appeared before the Council and <br />reported that the building is an existing office building owned and <br />operated by Indian Land Tenure Foundation. The Foundation would like <br />Co expand the building by approximately 1,500 square feet. The entire <br />building will then be resided with a horizontal lap siding to blend into the <br />residential area. The parking lot will be curbed and repaved as <br />recommended by the City Planner. Landscaping will also be upgraded per <br />the Planner's recommendation. <br />Blesener asked the impact on existing trees. Newberg replied that the <br />building addition may be reconfigured to save existing trees. There is one <br />large maple tree that will be removed. This tree, however, has many dead <br />branches and has exceeded its useful life. <br />Chris Stamberg, Indian Land Tenure, reported that the Foundation has <br />owned this property for the past three years. The Foundation is a national <br />non-profit that works on Indian land recovery throughout the country. He <br />reported that they are expanding their existing staff from 7 to 11 or 12 and <br />require the additional space. Office hours at the building range from 8:00 <br />a.m. until about 6:45 p.m. Mondays through Fridays. <br />Blesener noted that this office building has existed in this area for many <br />years, and felt that the rezoning to allow for an expansion of the building <br />
