MINUTES CITY COUNCIL AUGUST 24, 2005 Blesener asked if the developers have been working with the Watershed on this plan. Freeman replied that they have been in contact and will meet all the Watershed requirements. Allan asked about the existence of trees within the City's right-of-way. The City Planner indicated that the issue would be that of maintenance. The Planner supported the creation of a homeowners' association to maintain the easterly right-of-way as well as the island area. Blesener suggested that trees should not be too close to the pavement so as to interfere with snow plowing. Freeman reported that their engineer would work with the City Engineer and Public Works Superintendent on these issues and the development moves forward. Allan asked about the comment at the Planning Commission meeting from an adjacent property owner. Freeman indicated that the neighbor was concerned about the impact of run-off onto his property. However, the neighbor's property is higher. Freeman noted that they will be sizing ponding within the development to accommodate the run-off that comes from this neighbor's property. There was no one present from the general public wishing to comment on this matter. Upon motion by Blesener, seconded by LaValle, the public hearing was closed. Mr. LaValle introduced the following resolution and moved its adoption: RESOLUTION NO.2005-8-788 -APPROVING THE CONCEPT OF THE EVERGREEN HILLS DEVELOPMENT AS PRESENTED SUBJECT TO THE RECOMMENDATIONS OF THE CITY PLANNER AND THE PUBLIC WORKS SUPERINTENDENT The foregoing resolution was duly seconded by Allan. Ayes (5). Nays (0). Resolution declared adopted. CONCEPT Blesener reported that the developer has requested that concept review REVIEW - for the townoffice proposal for 2962 and 2968 Rice Street be tabled until 2962 AND the September 14, 2005 Council meeting. 2968 RICE STREET - Mr. Blesener introduced the following resolution and moved its adoption: JOHN MATTHEWS
