MINUTES <br />CITY COUNCIL <br />SEPTEMBER 14, 2005 <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />PAY The City Administrator reported that the City Engineer is recommending <br />REQUEST - approval of an amended pay request for Tower Asphalt based on some <br />TOWER additional documentation provided by Tower. <br />ASPHALT <br />Mr. LaValle introduced the following resolution and moved its adoption: <br />RESOLUTION NO.2005-9-204 -APPROVING THE AMENDED PAY <br />REQUEST FOR TOWER ASPHALT FOR 2005 IMPROVEMENTS IN <br />THE AMOUNT OF $460,189.26 AS RECOMMENDED BY THE CITY <br />ENGINEER <br />The foregoing resolution was duly seconded by Allan. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />CLOSED The City Attorney recommended that the Council call for a closed session <br />SESSION - to discuss the Dayspring litigation immediately following the Council <br />DAYSPRING meeting. <br />LITIGATION <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2005-9-205 -CALLING FOR A CLOSED <br />SESSION AT THE CONCLUSION OF THE REGULAR COUNCIL <br />MEETING TO DISCUSS THE DAYSPRING LITIGATION AS <br />RECOMMENDED BY THE CITY ATTORNEY <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />TRAFFIC <br />STUDY - <br />RICESTREET/ <br />COUNTY <br />ROAD B <br />INTERSECTION - <br />TRANSIT <br />STATION <br />The City Administrator reported that as previously discussed at <br />a Council workshop meeting, Metro Transit is considering the <br />development of a transit station on excess Highway 36 right-of- <br />way at the intersection of Rice Sheet and County Road B. The <br />proposed station would be large enough to accommodate 400 cars <br />as well as busses. The Administrator reported that St. Jude <br />Medical has expressed concern with the existing traffic volumes <br />as well as the configuration of this intersection. St. Jude is very concerned <br />about the impact thaC this transit station would have on the intersection. <br />7 <br />
