MINUTES CITY COUNCIL SEPTEMBER 14, 2005 The foregoing resolution was duly seconded by LaValle. Ayes (5). Nays (0). Resolution declared adopted. PAY The City Administrator reported that the City Engineer is recommending REQUEST - approval of an amended pay request for Tower Asphalt based on some TOWER additional documentation provided by Tower. ASPHALT Mr. LaValle introduced the following resolution and moved its adoption: RESOLUTION NO.2005-9-204 -APPROVING THE AMENDED PAY REQUEST FOR TOWER ASPHALT FOR 2005 IMPROVEMENTS IN THE AMOUNT OF $460,189.26 AS RECOMMENDED BY THE CITY ENGINEER The foregoing resolution was duly seconded by Allan. Ayes (5). Nays (0). Resolution declared adopted. CLOSED The City Attorney recommended that the Council call for a closed session SESSION - to discuss the Dayspring litigation immediately following the Council DAYSPRING meeting. LITIGATION Mr. Blesener introduced the following resolution and moved its adoption: RESOLUTION NO. 2005-9-205 -CALLING FOR A CLOSED SESSION AT THE CONCLUSION OF THE REGULAR COUNCIL MEETING TO DISCUSS THE DAYSPRING LITIGATION AS RECOMMENDED BY THE CITY ATTORNEY The foregoing resolution was duly seconded by LaValle. TRAFFIC STUDY - RICESTREET/ COUNTY ROAD B INTERSECTION - TRANSIT STATION The City Administrator reported that as previously discussed at a Council workshop meeting, Metro Transit is considering the development of a transit station on excess Highway 36 right-of- way at the intersection of Rice Sheet and County Road B. The proposed station would be large enough to accommodate 400 cars as well as busses. The Administrator reported that St. Jude Medical has expressed concern with the existing traffic volumes as well as the configuration of this intersection. St. Jude is very concerned about the impact thaC this transit station would have on the intersection. 7
