The Administrator indicated thaC if there is contamination <br />encountered during construction, it will have to be dealt with. <br />Keis noted that if contamination is found, then Magellan and the PCA will <br />have to address it. The Administrator agreed. He noted that Little Canada <br />has no provision in its code to require that soil testing be done to <br />determine whether or not there is contamination. <br />David Brausen, Viking Drive, noted that his property abuts the area at the <br />end of the proposed cul-de-sac. He pointed out that there is no buffer <br />between his backyard and the proposed Preserve Court. Brausen asked if <br />something changed with Che Magellan pipeline and its easement, whether <br />or not he could subdivide off the back of his loC. <br />Blesener replied Chat there would be that potential. It was noted that <br />Brausen would have a cul-de-sac lot which would require 75 feet of width <br />at the building line, noC at Che street. It was further noted, however, Chat <br />the Magellan pipeline easement runs through this area, thus impacting the <br />ability to subdivide the property. <br />Tom Kelly, Viking Drive, pointed out that he has a shed on his property <br />thaC was part of the clean up of a previous pipeline leak. Kelly stated that <br />it is his understanding that during consri~uction, should he smell gas, this <br />could be an indication of contaminated soils and he should call to report it. <br />The City Administrator again commented that there is no provision in the <br />City's code to require testing. If contamination is encountered, it is his <br />understanding that the PCA should be called. <br />Dan Arcand, Viking Drive, noted that the proposed development will put a <br />road on Chree sides of his property as well as a tiered retaining wall along <br />the back. Arcand expressed opposition to the development as well as <br />concern about the development's impact on the ecology of the area. <br />Arcand pointed out That this area is currently an ecological gem, and the <br />loss of nearly all the trees and the addition of rooftops will destroy this <br />area. Arcand stated that he did not see the development as a common <br />sense move. He pointed out that the woods and swamp are a hidden jewel. <br />Arcand stated that he was deeply concerned about the impact this <br />development will have on the area as well as concerned abouC Che pipeline. <br />Arcand stated that the Preliminary Plat should never have been approved, <br />and he would hope thaC the City Council does not approve the Final Plat. <br />There was no one else present from the general public wishing to <br />comment on this matter. <br />22 <br />
