MINUTES <br />CITY COUNCIL <br />SEPTEMBER 28, 2005 <br />would probably be allowed, but final approval would need to be granted by the City <br />Council. The Developer revised his final plans and submitted them with a 4-foot wall in <br />this area. With a possib]e resolution to the size of the wall, the plan was reviewed in <br />further detail as to the implications of the wall construction and the ability to construct <br />and maintain the wall and the public infrastructure on the botCOm side of the wall. There <br />is approximately 10 feet of boulevard within City right-of-way from the back of the curb <br />to the adjacent property line. The wall is 6 feet from the back of the curb leaving <br />approximately 4 feet between the property line and the wall. A storm sewer flared end is <br />proposed for drainage of a low point at the bottom of the wall. Once completed the <br />responsibility of maintaining the storm sewer will revert to the City. With only 4 feet of <br />right-of-way at the bottom of the wall, no equipment or even a pickup could access Che <br />inlet and all maintenance would need Co be done from the top of the wall over the <br />guardrail It is our recommendation that the Developer be required to obtain a minimum <br />of an 11 foot easement from the east end of the wall to the inlet from adjacent property <br />owners to allow a 15 foot access width Co the storm sewer inlet at the bottom of the wall. <br />9. The City Building Inspector noted that in accordance with Minnesota State Building <br />Code 1303.1600 the minimum soil frost protection is 3.5-feet for building sites. The <br />protection must extend laterally as well as horizontally. Therefore, retaining walls must <br />be at least 42-inches away fi•om the foundation of any home to provide for this protection <br />unless a licensed Engineer provides a signed plan detailing an alternative. It appears that <br />some walls are within the minimum 42-inches. The walls must be revised or signed <br />drawings provided prior to final grading plan approval. <br />10. The Developer should review the ground floor and lowest floor shown for the building <br />pad on Lot 4. As currently shown, the driveway would be at 11.8% and retaining walls <br />are necessary on three sides to support the lot due to the high elevations. <br />Utility Plan <br />1. The storm structures on Preserve Trail should be moved back to the radius point and an <br />additional structure added at the radius point of Preserve Court to move the storm line <br />under the curb and away from the retaining wall to the east of Preserve Trail. <br />2. The storm sewer outlet from the street into the east pond discharges above the normal <br />water level. The outlet should be extended to allow discharge at the normal water level <br />of the pond to prevent erosion problems. The orientation of the outlet should be towards <br />the middle of the pond not towards a pond bank to minimize erosion. As shown it <br />appears that this storm sewer line is outside of the drainage and utility easements being <br />provided. The finished ground elevation should be shown in the profile view of the plans <br />and a drainage and utility easement be granted over the pipe. The width of the easement <br />should be a minimum of twice the maximum depth of [he pipe and be centered over the <br />pipe. <br />3. There is an existing sanitary sewer line along Che west side of Lot 1 that is approximately <br />11 feet deep. The plat is currently providing a 20-foot drainage and utility easement on <br />the west side of Lot 1. The sanitary sewer is noC centered within the easement currently <br />being granted; therefore additional easement width should be provided to allow for <br />maintenance. Given Che 11-fooC depth of the sewer it is our recommendation that the <br />easement be extended to the east a minimum of 11 feet from centerline of the pipe. <br />28 <br />
