MINUTES <br />CITY COUNCIL <br />OCTOBER 12, 2005 <br />The City Administrator reported that if the vacation of Park Sheet is <br />approved, the additional land that the School DistricC would gain would be <br />used to expand their soccer fields. The School District has no intention of <br />utilizing this additional property for field parking. The Administrator <br />reported that the School District has indicated that the field expansion is a <br />long term goal and may not be done right away. <br />With regard to the location of the private drive that exists on the Park <br />StreeC right-of-way, the Administrator reported that the City Engineer has <br />determined that the drive is not centered on the centerline of the right-of- <br />way, but encroaches approximately 5 feet to the east. The Administrator <br />indicated that based on the pavement location, a reasonable alternative <br />may be to vacate 20 feet of the easterly right-of-way. The City would also <br />retain drainage and utility easements over the vacated area. The <br />advantages of doing so are: <br />/ Allows the School District to expand field usage in the future. <br />/ Protects public utilities in the area. <br />/ Would eliminate the troublesome parking of equipment and <br />vehicles along the school district fence. <br />/ Allows Terrace Heights' driveway to continue in its present <br />location while still providing room for snow storage on Che east <br />side of the drive (approximately five feet). <br />/ Avoids the need for easements or moving the drive serving Terrace <br />Heights if a greater area were to be vacated. <br />The Administrator indicated that there may be liability issues for the City <br />in having a private drive on public right-of-way. Another alternative <br />would be to vacate Che entire Park Street right-of-way while retaining the <br />necessary utility easements subject to the School District deeding over the <br />westerly 10 feet of vacated right-of-way they would gain Co Terrace <br />Heights Mobile Home Park so that their access drive can continue to exist <br />in its current location. The School District has indicated that they may be <br />workable from their perspective, but would have to bring the issue to the <br />School Board. <br />Blesener noted that the Park Street right-of-way is the only right-of-way <br />that has not been vacated in this area. Blesener stated that as long as the <br />right-of-way is bordered by the School District and the mobile home park, <br />it is unlikely it would ever be improved. <br />LaValle asked when the School DistricC would be moving its fence. The <br />Administrator indicated that they have noC indicated the timing for moving <br />the fence. The Administrator noted that Che City will be relocating the <br />School District fence along County Road B-2 East as part of the street <br />2 <br />
