LaValle felt that the fence relocation was a paramount issue, indicating that if the street is vacated and the fence not moved, the existing code enforcement issue will likely increase and Che City will have lost some control over the issue. LaValle felt thaC Park SCreet should not be vacated until the time Chat the School District is willing to move the fence. The City Administrator felt that regardless of whether Park SCreet is vacated or not, the City would still be able to enforce its codes. The question is how aggressively the codes are enforced. Allan stated that it was her understanding that the illegal parking is the result of people coming to watch the games on the ballfields. The City Adminish~ator indicated that the illegal parking may be from unauthorized groups using the ballfields. The Council felt that the proposed vacation should be tabled at this time and that the City Administrator should determine when the School District would be willing to move the fence. Blesener noted, however, that there appears to be no public purpose to retain this section of Park Street righC- of-way. Mr. LaValle introduced the following resolution and moved its adoption: RESOLUTION NO.2005-IO-235 -TABLING ACTION ON THE PROPOSED VACATION OF PARK STREET FROM COUNTY ROAD B-2 EAST TO DEMONT AVENUE PENDING ADDITIONAL INFORMATION RELATIVE TO SCHOOL DISTRICT FENCE RELOCATION The foregoing resolution was duly seconded by Keis. Ayes (5). Nays (0). Resolution declared adopted.
