MINUTES <br />CITY COUNCIL <br />OCTOBER 17, 2005 <br />rate. The Administrator noted that the property is an existing lot of record <br />and as such is proposed to be assessed at the minimum residential rate as <br />set forth in the City's assessment policy which was adopted in the early <br />1990's. <br />The resident asked where the burden of proof lies in determining whether <br />or not the property is developable. <br />The City Administrator indicated that the City can ask the Watershed to <br />look at the property. The Administrator stated that he thought the question <br />related to whether or not the property could be upzoned. <br />The resident indicated that a developer is not interested in the property <br />until it is determined that iC is buildable. <br />The City Administrator indicated that he would contact the Watershed <br />relative to the wetland issues. He also recommended that the property be <br />assessed as proposed. If it is proven that the property is within a wetland <br />and camrot be developed, then the City can abate the assessment at that <br />time. <br />There was no one else present wishing to comment. <br />Mayor Blesener noted the one written objection received from Mr. Joel <br />Brown. The City Administrator recommended that the objection be <br />received, but there be no change in the assessment as proposed given that <br />the objections raised by Mr. Brown do not impact the benefits received <br />from the assessment. <br />Blesener stated that the City understands the inconveniences experienced <br />by the Brown's relative to the issues raised in their letter. He agreed, <br />however, that the property still received the benefit of the improvement. <br />LaValle noted that the City Engineer will review the Brown property Co <br />ensure that it is properly restored. <br />Upon motion by Montour, seconded by LaValle, the public hearing was <br />closed. <br />Mr. Blesener inh•oduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2005-IO-245 -ACKNOWLEDGING RECEIPT OP <br />THE WRITTEN OBJECTION TO ASSESSMENT SUBMITTED BY <br />MR. AND MRS. JOEL BROWN, IIO COUNTY ROAD B-2 EAST, AND <br />DENYING THE OBJECTION TO THE ASSESSMENT BASED ON <br />THE COUNCIL'S DISCUSSION <br />
