MINUTES <br />CITY COUNCIL <br />NOVEMBER 23, 2005 <br />There was no one present from the general public wishing to comment on <br />this matter. <br />Upon motion by LaValle, seconded by Keis, the public hearing was <br />closed. <br />Mr. Montour introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2005-II-269 - REZONING A PORTION OF <br />NADEAU PARK FROM SINGLE-FAMILY RESIDENTIAL (R-I) TO <br />PUBLIC (P) AS RECOMMENDED BY THE PLANNING <br />COMMISSION AND THE PARKS & RECREATION COMMISSION <br />The foregoing resolution was duly seconded by Allan. <br />Ayes (5) Montour, Allan, Blesener, Keis, LaValle. <br />Nays (0). Resolution declared adopted. <br />TEXT Mayor Blesener opened the Public Hearing to consider a Text <br />AMENDMENT Amendment to allow tattoo parlors as a Conditional Use in the General <br />& CUP - Business District (B-3) and a conditional Use PermiC allowing Beloved <br />2760 Ink to operate a tattoo parlor at 2760 Lakeshore Avenue. Blesener <br />LAKESHORE noted that at the Planning Commission a motion was made to approve <br />AVENUE - the Text Amendment and CUP, however, that motion failed on a vote <br />BELOVED of two in favor and three against. Blesener further noted Chat at the <br />INK Council level a Text Amendment requires four votes in favor to approve <br /> while a Conditional Use Permit requires three votes in favor. <br />Blesener noted that the Council has received reference letters on behalf of <br />Brandon Heffron, the applicant. Also received is a letter from Mr. <br />Heffron in response to comments made at the Planning Commission <br />meeting as well as a petition against the Text Amendment that was signed <br />by approximately 120 Little Canada residents. <br />Blesener noted that the Council has a lot of information on the proposed <br />Text Amendment and there are a lot of options to be considered. He <br />indicated that his feeling is that Che City cannot prohibit any legal business <br />from locating in the City; however, the City has the option to put <br />restrictions on where businesses can locate as well as require the licensing <br />of businesses. Blesener stated that it was his feeling that 2760 Lakeshore <br />Avenue was not the proper location for a tattoo parlor. He indicated that <br />the City could draft an ordinance that would allow tattoo parlors in the <br />proper location. <br />LaValle stated that he did not have a problem with tattoo parlors, but <br />indicated that the problem he has with the proposal is the proposed <br />2 <br />
