MINUTES <br />CITY COUNCIL <br />AUGUST 12, 2015 <br />QUIET ZONE <br />BONDING <br />AGREEMENT <br />REVISIONS <br />EAGLE SCOUT <br />PROJECT <br />The City Administrator reported that the Council previously approved an <br />agreement with the State that provides for the receipt of grant funds <br />provided by the Legislature in 2014 for the upgrade to the City's six <br />at -grade railroad crossings which is necessary to implement a Quiet Zone. <br />The City was granted $1,250,000 of bond funds by the Legislature to <br />implement these improvements. The Administrator reported that MN <br />DOT, as the oversight agency, has made a number of revisions to the <br />previous draft of the agreement, which triggers a revised grant agreement. <br />MN DOT has also requested a resolution addressing several new <br />requirements. These include a reference to the State Statute which gives <br />the Council the authority to enter into the agreement with MN DOT and <br />the Railroad; a commitment of local funds to fully fund the project; a <br />statement that the City will fund any maintenance requirements over the <br />20 -year bond period if the Railroad does not perform the maintenance; <br />that the City's insurance meets applicable requirements; and that the city <br />will cover any costs that exceed the amount of funds provided by the State <br />to complete the project. <br />The Administrator reported that it is his understanding that the Railroad <br />will move forward with some of the work this fall with completion in the <br />spring and implementation of the Quiet Zone shortly thereafter. The <br />Administrator also indicated that there will be an amended agreement with <br />the Railroad presented to the Council at an upcoming meeting. He noted <br />that based on the initial agreement with the Railroad, the Railroad began <br />the design work necessary which allowed them to identify the needed <br />equipment and materials and place that order. <br />Montour introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2015-8-159 — AUTHORIZING THE EXECUTION <br />OF THE GENERAL OBLIGATION BOND GRANT AGREEMENT <br />WITH THE STATE OF MINNESOTA BY THE MAYOR AND CITY <br />ADMINISTRATOR ON BEHALF OF THE CITY <br />The foregoing resolution was duly seconded by McGraw. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />The Parks & Recreation Director reported that Boy Scout Cory Huot has <br />proposed to construct a pergola over the picnic table in Veteran's <br />Memorial Park as part of earning his Eagle Scout designation. The Parks <br />& Recreation Commission has reviewed and approved this proposed <br />project and has recommended that the City contribute $500 toward the <br />cost of materials.
