MINUTES <br />CITY COUNCIL <br />OCTOBER 14, 2015 <br />expenses relative the situation involving loss of duplex status for the <br />property. Also, improvement of the property ensures that it is not a <br />blighting influence on the neighborhood, and potential safety and health <br />issues associated with the property are being eliminated. The <br />Administrator pointed out that the agreement states that Mr. Berres will <br />not be allowed to interfere with contractors on the job or retain his own <br />contractors without coordinating with HRC. Mr. Berres will also make an <br />escrow deposit with the City to cover the cost of the approved work scope. <br />Two family home state will not be granted until the rehab work is <br />completed and Mr. Berres obtains a rental license for the one rental unit. <br />Keis introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2015-10-202 — APPROVING THE REVISED <br />DEVELOPMENT AGREEMENT WITH MR. ROGER BERES FOR <br />THE REHABILITATION OF 2955 AND 2957ARCADE STREET AS <br />PRESENTED AND AUTHORIZING THE MAYOR AND CITY <br />ADMINISTRATOR TO EXECUTE THE AGREEMENT ON BEHALF <br />OF THE CITY <br />The foregoing resolution was duly seconded by Torkelson. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />CALL FOR The City Administrator reported that the North Suburban Cable <br />PUBLIC Commission (NSCC) has recommended approval of a cable franchise <br />HEARING- with CenturyLink. As a result the member cities must hold a public <br />CABLE hearing as well as adopt a franchise agreement as part of the process. <br />FRANCHISE The Administrator recommended that the public hearing be scheduled <br />TO for October 28, 2015. Once the hearing is held, the City could not be <br />CENTURY able to act on a franchise agreement for a minimum of 7 days. As a <br />LINK result, consideration of the adoption of the franchise areement with <br />CenturyLink would be scheduled for the November 9thCouncil meeting. <br />Montour reported that a second cable franchise would be a good <br />opportunity for both the City and Little Canada cable subscribers. Keis <br />asked about infrastructure. Montour reported that CenturyLink's build out <br />plans have not yet been submitted. If the cable franchise agreement is <br />approved, there will be meetings with NSCC staff relative to the build out. <br />Montour also estimated that the build out of the entire City may take up to <br />five years. <br />The City Administrator reported that State Law allows for up to a five <br />year build out; however, Federal Law allows a longer build out.
