MINUTES <br />CITY COUNCIL <br />OCTOBER 14, 2015 <br />Tim McGlaughlin, Market Place Shopping Center, reported on the build <br />out of the restaurant space and felt the restaurant would be a good addition <br />to the community. <br />Joe Vitale, The Little Venetian, reported that while he had no objections to <br />the restaurant, he was concerned about the addition of a liquor license. <br />Vitale felt that the number of liquor licenses in the City was at the <br />saturation point noting several businesses in the immediate area with <br />liquor licenses. Montour agreed that liquor licenses may be at the <br />saturation point, but indicated that the liquor licenses held by bars versus <br />restaurants were not in the same category. Montour pointed out the <br />additional requirements for On -Sale Restaurant Liquor Licenses. Montour <br />agreed that there was a saturation for liquor licenses, but indicated that he <br />was not sure what that was. Montour stated that he felt pressured to add <br />the liquor license given that the build out of the restaurant is almost <br />completed. He indicated that he would have appreciated some time to <br />think about this issue. <br />Fischer agreed and stated that he felt somewhat blindsided. Fischer felt <br />that the property owners have an obligation to businesses wanting to rent <br />space to inform them of issues such as limits on liquor licenses. Fischer <br />also indicated that he is supportive of new restaurants locating in Little <br />Canada. Fischer did comment that even if he had more time to consider <br />the issue, he was not sure he wouldn't come to the same conclusion. <br />McGraw agreed that McGlaughlin has a responsibility to advise <br />prospective tenants of issues such as liquor license limits before leasing <br />space to these tenants. McGraw felt that to deny the request at this point <br />was a disservice to the restaurant owner and the investment they have put <br />in the property. McGraw indicated that he would prefer to see these <br />requests made at the concept stage. Keis agreed that these requests should <br />be made in the appropriate order, and not after a restaurant build out is <br />nearly completed. <br />There was Council discussion relative to whether or not there was support <br />for adding an On -Sale Restaurant License given the need for staff to bring <br />an ordinance back to the Council for action. The consensus was in <br />support. <br />Fischer introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2015-10-196 — DIRECTING CITY STAFF TO <br />PREPARE AN ORDINANCE AMENDMENT RELATIVE TO THE <br />ADDITION OF AN ON -SALE LIQUOR RESTAURANT LICENSE <br />WITH THE CHANGE IN CONDITIONS AS DISCUSSED THIS <br />7 <br />
