MINUTES
CITY COUNCIL
APRIL 28, 2004
The foregoing resolution was duly seconded by Montour.
Ayes (4) Blesener, Montour, Fahey, Anderson.
Nays (0). Resolution declared adopted.
TEXT Mayor Fahey opened the public hearing to consider a Text Amendment
AMENDMENT to the Sign Ordinance relative to the number of signs allowed in the
TO SIGN General Business Zoning District (B-3). It was noted that the Planning
ORDINANCE Commission has recommended approval of the Text Amendment.
Fahey asked the impact that adoption of this Text Amendment might have
on the rest of the City. The City Planner felt that given there are very few
private streets within the City and most of those are located in PUD
Districts, the impact of this Text Amendment would be minor.
']'here was no one from the general public present wishing to comment on
this matter.
Upon motion by Blesener, seconded by Montour, the public hearing was
closed.
Anderson noted that the Text Amendment states that a private street
"may" qualify a property as a corner lot. The City Planner indicated that
the wording is intended to give the City discretion on a case-by-case basis.
The ordinance would allow the Zoning Administrator to make a
determination as to whether or not a property is a corner lot for purposes
of applying this ordinance. If the property owner disagrees with the
interpretation, the property owner could make an appeal to the City
Council.
Anderson asked if the ordinance would be used for determining corner lot
status for any other issue than signs. The City Planner replied that the
ordinance is specific to sign determination only, and would not carry over
to other issues.
Mr. Montour introduced the following resolution and moved its adoption:
RESOI, UT10N NO. 2004-4-XO - ADOP'T'ING AN ORDINANCE
AMENDING CHAPTER 903.770 OF TILE LITTLE CANADA CITY
CODE, KNOWN AS THE ZONING ORDINANCE, ]3Y PROVIDING
FOR THE NUMBER OF SIGNS IN 'T'HE 13-2 THROUGH73-I, I-I, I-2,
AND I-P DISTffiCTS
The foregoing resolution was duly seconded by Blesener.
Ayes (4) Montour, Blesener, Fahey, Anderson.
