MINUTES <br />CITY COUNCIL <br />MAY i 1, 2004 <br />With regard to the Biagini/CI Title property, the City Administrator noted <br />that he has informed Mr. Biagini that the City will not deed over the land <br />to him at this time. However, as long as Mr. Biagini continues to make his <br />TIF guarantee payments, he would have exclusive right to develop this <br />property. <br />With regard to the Frattalone property at 3066 Spruce Street, the City <br />Administrator indicated that Mr. Frattalone has three potential buyers <br />interested in the site. Mr. Frattalone maybe seeking the Council's input <br />on the issue of outdoor storage on the section of the site that is zoned I-P <br />District. The Administrator indicated that he has informed Mr. Frattalone <br />that as long as the new use is consistent with the current use, outdoor <br />storage would be allowed as currently exists. <br />Fahey agreed, and indicated that if the section of land zoned I-P is sold for <br />development, the property would have to be developed under the I-P <br />.District standards. <br />Blesener stated that he had no problem with a similar use of the property. <br />The City Administrator indicated that Mr. Frattalone may address the <br />Council on this issue at the May 26°i meeting. <br />CODE The Code Enforcement Officer addressed the Council on a number of <br />ENFORCEMENT pending code enforcement issues. The first relates to the Buck Blacktop <br />property. The Code Enforcement Officer indicated that she will be <br />addressing the outdoor storage issues on this property over the next couple <br />of months. <br />The next property was the Precision Tree site and the pending Amendment <br />to Conditional Use Permit relative to outdoor storage issues on this <br />property which will be processed as part of the June planning cycle. The <br />Officer reported that Precision Tree may be expanding their development <br />request to include a rezoning of the property to PUD in order to expand <br />their outdoor storage on the site. Another option they are exploring is the <br />development ofmini-storage building on the site, which would expand the <br />amount of outdoor storage that they are allowed. The Officer reported that <br />the City is also continuing to receive complaints about odors coming from <br />the alternative heat source that Precision Tree installed without a permit. <br />Agaiu, this matter will be reviewed by the Planning Commission and <br />Council during the June cycle. <br />
