MINUTES <br />CITY COUNCIL <br />MAY 11, 2004 <br />The Code Enforcement Officer reported that the Buetow Bros. site has <br />been purchased by Arcade Electric. As a result, the code violations on the <br />site should be cleaned up in the not too distant future. <br />The next issue is that of the Xcel Energy site on Rice Street and the issue <br />of the outdoor storage of vehicles and contractor equipment on that site. It <br />was noted that the City just received correspondence from Xcel Energy's <br />attorney relative to their claim of continued and consistent use of this site <br />for outdoor storage since 1960. The Code Enforcement Officer reported <br />that she obtained aerial photos from the Watershed showing no outdoor <br />storage on the site. The adjacent property owner has also indicated that <br />his recollection is that the outdoor storage use began about 25 years ago <br />and that there was perhaps only one truck parked on the site, and it has <br />only been the past 12 to 15 years that the heavy outdoor storage use has <br />existed. The City will be contacting other neighboring property owners to <br />determine their recollection of this use. <br />The City Administrator reported that the City Attorney has informed us <br />that State Statute requires the discontinuance of a use for a period of one <br />year before grandfather rights are terminated. <br />The Code Enforcement Officer reported that the Valor request for an <br />Amendment to Conditional Use Permit for outdoor storage is being <br />processed during the May planning cycle. This matter had been delayed <br />for several months at the applicant's request for additional time to obtain <br />an engineering study of his site drainage. This applica~rt has now <br />indicated that he will not be providing additional site drainage information <br />and wants to proceed with the amended site plan he originally submitted. <br />The Officer reported that Sherman Associates will be closing on their <br />purchase of the back portion of the Ultimate Crolf property by June 1". As <br />a result, the property will be cleaned up and the outbuildings demolished. <br />The next property reviewed was Dan's Auto on Centerville Road. The <br />Officer reported that she issued a citation for the violations on this site and <br />will continue to do so until the property is brought into conformance. <br />The Code Enforcement Officer indicated that there is one motorhome left <br />at the Little Canada Hall site. The property owner has until the end of <br />May to remove this motorhome. The property owner has indicated that <br />the tenant will likely break their lease if the motorhome is not allowed to <br />remain. The Officer reported that citations will begin to be issued on June <br />1" if the motorhome is not removed. <br />
