MINUTES <br />CITY COUNCIL <br />MAY 2G, 2004 <br />not reflect the park dedication that was required of Mr. Frattalone at the <br />time he proposed the PUD for this property except for the Pioneer Cabinet <br />site. Typically 5% of the land value would be required, less the Pioneer <br />Cabinet property, less the value of the trail that is being improved. <br />Frattalone pointed out that the City required a 15 foot wide trail easement <br />from St. Paul Water, and he has dedicated a 30 foot wide easement. He <br />noted that he was also required to improve a wood chip path on that <br />easement. <br />The City Administrator noted that there is a 15 foot no disturb zone along <br />Blacktern Pond, therefore, the l5 foot trail easement had to be outside the <br />15 foot no disturb zone, essentially resulting in a 30 foot trail easement. <br />Wood chips were required for the trail given this is an environmentally <br />sensitive area. <br />The Council requested copies of the minutes from the park dedication <br />discussion so they could review them prior to making a decision on this <br />issue. <br />Frattalone pointed out that he is also requesting approval of the installation <br />of a fuel station canopy as part of his PUD Amendment. <br />Blesener asked Frattalone's plans for the Pioneer Cabinet property. <br />Frattalone indicated that he would be using the property for parking. <br />There was no one present from the general public wishing to comment on <br />this area. <br />Upon motion by Montour, seconded by Blesener, the public hearing was <br />closed. <br />LaValle introduced the following resolution and moved its adoption: <br />REb`OI UTION NO. 2004-5-106 -APPROVING THE AMENDMENT <br />TO P] ANNED UNIT DEVELOPMENT REI ATIVE TO FENCING <br />AND OTFIF.'R SITE IMPROVEMENTS TOR 3205 b'PRUCE STREET, <br />FRATTALONE F,XCAVATING, BASED ON THE <br />RECOMMENDATION OF THE CITY PLANNER AND TFIE <br />PLANNING COMMISSION, NOT]NG THAT THlb' RESOLUTION <br />DOES NOT ADDRESS THE PARK CHARC;E ISSUE <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (5) LaValle, Blesener, Fahey, Anderson, Montour. <br />Nays (0). Resolution declared adopted. <br />16 <br />
