Resolution declared adopted. <br />PRELIMINARY Mayor Fahey opened the continuation of Public Hearing to consider a <br />PLAT -BIDDEN Preliminary Plat for Hidden Acres, asingle-family home development <br />ACRES consisting of eleven (11) single family lots as well as opened the Public <br />Hearing to consider application for a Conditional Use Permit for a <br />Residential Planned Unit Development to allow variance in side yard <br />setbacks. Fahey reviewed the recommendation of the Planning <br />Commission for approval of Option 2 for the Hidden Acres Preliminary <br />Plat which involves road connections to Burke Lane, Yorkton Ridge, as <br />well as Condit Street via the existing 30-foot Nadeau Road right-of=way <br />plus an additional 20 feet ofright-of--way for Nadeau Road. It was noted <br />that the Planning Commission further recommended approval of the <br />original Preliminary Plat submitted (Option 3) should it not be feasible to <br />proceed with Option 2. The Planning Commission also recommended <br />approval of the CUP for Residential Planned Unit Development allow a 5 <br />foot side yard setback on the garage side of the proposed houses in Hidden <br />Acres. <br />Fahey indicated that he was opposed to approval of the CUP for <br />Residential Planned Unit Development for the 5-foot side yard setback, <br />noting that the City has denied similar variance requests in the past. Fahey <br />felt that use of a PUD to make departures from setback requirements was <br />not appropriate. He further indicated that if the Council is inclined to <br />allow a 5-foot side yard setback for garages in the Hidden Acres <br />development, than a full study should be done of the setback issue and a <br />text amendment approved allowing the same benefits to other residential <br />property in the City. <br />With regard to the Preliminary Plat, Fahey indicated that he preferred <br />Option 2. Fahey noted that it appears that it is not feasible to direct storm <br />water to the existing Yorkton pond, and that the Hidden Acres plat will <br />include a small storm water retention pond Gordie Howe, Masterpiece <br />Homes, indicated that this is correct. <br />Fahey explained the three layout options being considered for the Hidden <br />Acres. Option 1 involves road connections to Burke Lane, Yorkton Ridge, <br />and to Condit Street between the homes at 2883 and 2891 Condit Street. <br />Option 2 involves road connections to Burke Lane, Yorkton Ridge, and to <br />Condit Street via Nadeau Road (plus 20 additional feet of right-of--way for <br />Nadeau Road from 2883 Condit Street). Option 3 involves road <br />
