MINUTES <br />CITY COUNCIL <br />MAY 26, 2004 <br />utilize the existing Nadeau Road right-of--way for this traffic depending on <br />weather conditions. The Administrator noted that it is to the City's benefit <br />to keep construction traffic off existing streets. Gordie Howe indicated <br />that they would utilize Nadeau Road whenever possible, but may have to <br />use Burke Laue and Yorkton Ridge as well. <br />Joseph Kueppers, attorney representing David Miller and Teresa Estes at <br />2883 Condit Street, indicated that they were opposed to the City's taking <br />20 feet of their property for right-of--way for Nadeau Road. Kueppers <br />pointed out that the Miller house sits at the far south edge of the property, <br />therefore, taking 20 feet for Nadeau Road would result in the house being <br />non-conforming. Kueppers noted that the Millers are in the process of <br />adding on to their home and indicated that an 8-foot entry area has been <br />added to the front of the house. Kueppers indicated that the entry area was <br />constructed in accordance with the plans submitted and the City-issued <br />building permit. Kueppers felt that improving Nadeau Road would <br />devalue the Miller property given that the house would be so close to the <br />road. Kueppers indicated that if the Millers had had any idea that the City <br />would take additional right-of--way from them for Nadeau Road, they <br />would not have put the addition on to their house, or they would have put <br />the addition on the north side of their house. Kueppers indicated that with <br />the improvement of Nadeau Road, the Millers will walk out their front <br />door and be roughly 25 feet from the road right-of--way and 35 feet from <br />the pavement. Kueppers indicated that the Millers have atwo-year-old <br />son and are concerned with having a road so close to their front door. <br />Kueppers pointed out that with the improvement of Nadeau Road and the <br />future improvement of Condit Street, which will require additional right- <br />of-way from the Miller property, their house will be boxed in by roads. <br />Kueppers stated that the improvement of Nadeau Road completely <br />devalues the addition to the Miller house and substantially devalues their <br />property. <br />Fahey asked if there would be a setback issue for the Miller house on the <br />east once Condit Street is improved. Kippers replied that the only non- <br />conforming setback would be on the south due to the improvement of <br />Nadeau Road. <br />Kueppers also pointed out that the improvement of Nadeau Road will <br />result in the loss of substantial trees. Kueppers indicated that the Millers <br />were not aware that the potential to improve Nadeau Road existed at the <br />time they started the addition to their home. <br />Blesener pointed out that the Miller property sits next to dedicated right- <br />of-way for Nadeau Road. Blesener also pointed out that Mr. Miller <br />requested the vacation of Nadeau Road last year. At the time, the City <br />indicated that it would vacate Nadeau Road if the Millers would dedicate <br />road right-of--way on the north side of their property as well as for Condit <br />
