MINUTES <br />CITY COUNCIL <br />MAY 26, 2004 <br />Street in order to provide for future compliance with the City's <br />thoroughfare plan for the area. Without the dedication ofright-of--way <br />from the north side of the Miller property, the City indicated it would not <br />vacate Nadeau Road, but rather retain it for future access for the property <br />to the west. Blesener indicated, therefore, that the Millers were aware of <br />the thoroughfare plan and its potential impact on their property. <br />Kueppers reported that he was not a part of those discussions. Kueppers <br />further noted that the Hidden Acres plat could be approved as originally <br />proposed by the developer (Option 3) without impacting the Miller <br />property. Option 3 conforms to the City's requirements, therefore, <br />Kueppers questioned the expenditure of City dollars for the Nadeau Road <br />access. <br />Fahey noted the significant concern that has been expressed by the Burke <br />Lane and Yorkton Ridge neighborhoods relative to Option 3 and its <br />resulting traffic flows. Fahey indicated that Option 2 provides for a <br />greater good for the area resolving public safety concerns. <br />Fahey noted that while a building permit was issued for the addition of the <br />envy area for the Miller house, there is some question whether the <br />addition was put on in conformance with the plan submitted. Fahey also <br />indicated that in situations where City actions for the public good have <br />resulted innon-conformities, the City has granted variances to the <br />impacted properties. Fahey noted that it is not cost-effective to connect <br />Hidden Acres to Condit Street with a road connection on the north side of <br />the Miller property due to economic demands. Option 2 is a viable <br />alternative the requires the acquisition of 20 feet of additional right-of--way <br />from one property. <br />Kueppers suggested that rather than acquiring the full 20 feet from the <br />Miller property, that 10 feet be acquired from Miller and ] 0 feet from the <br />property to the south. Blesener noted that he believes the original 30 feet <br />came entirely from the property to the south. Anderson pointed out that <br />acquiring the 20 feet from the Miller property provides for a better road <br />alignment. <br />The City Planner suggested that if the City acquire approximately 16.8 <br />feet from the Miller property versus the full 20 feet, that the issue of the <br />non-conforming front yard setback for the entryway addition is eliminated. <br />The Planner pointed out that a full width street could still be improved on <br />the approximately 48 feet of Nadeau Road right-of--way. <br />Kueppers indicated that it was their position that they did not want Nadeau <br />Road improved and the road connection for Hidden Acres should occur on <br />the north side of the Miller house. The Millers are concerned that their <br />front door would be too close to Nadeau Road. Again, Kueppers indicated <br />
