MINUTES <br />CITY COUNCIL <br />MAY 2G, 2004 <br />John Anish, Yorkton Ridge, stated that comments have been made that <br />Option 3 is a viable option and meets the City's Codes. Anish disagreed <br />pointing out that Option 3 does nothing to address the entrance into Burke <br />Lane and the resulting problems of emergency vehicle access. <br />Blesener stated that Option 3 meets the legal requirements of the Code, <br />but agreed that the access into Burke Lane was poor. Blesener stated that <br />this is one of the reason why Options 1 and 2 are preferable to Option 3. <br />Nick Curtis, Burke Lane, asked about traffic signage once the new streets <br />are developed. The City Administrator noted that these details will be <br />worked out as part of the development agreement for the Hidden Acres <br />plat. <br />'T'here was no one else present from the general public wishing to <br />comment on this matter. <br />Upon motion by Blesener, seconded by LaValle, the public hearing was <br />closed. <br />Blesener indicated that he supported Option 2 with a reduced right-of--way <br />for Nadeau Road as abuts the Miller property. <br />Anderson noted the apparent dispute as to whether or not the entryway <br />addition to the front of the Miller house conformed to the building permit <br />application. Anderson questioned whether decreasing the amount of right- <br />of-way for Nadeau Road served the conununity well. <br />Fahey indicated that at times it is a balancing act between the public good <br />and not taking more than is necessary from atl individual property owner. <br />Blesener pointed out that the structure is there, and whether the road right- <br />of-way is 50 feet or 46 feet will not make a big difference. Blesener stated <br />that he was willing to live with a 46-foot right-of--way for a portion of the <br />street and not make the Miller front yard setback non-conforming. <br />Anderson stated that he would support Option 2 for the Hidden Acres plat. <br />Ilowever, he also felt that property owners should have to obtain building <br />permits when required and comply with building permits as issued. It <br />appears that there is conflicting information in the Miller building permit. <br />Montour stated that he supported Option 2 as he felt it was the best <br />solution for the entire neighborhood. Montour stated that his only concern <br />was the cost of acquiring additional right-of--way for Nadeau Road. <br />The City Administrator noted that in analyzing costs, the use of TIF was <br />first considered.
