MINUTES <br />CaTY COUNCIL <br />JULY 14, 2004 <br />of the project is estimated at $'142,800, a $95,000 Community <br />Development Block Grant was obtained for the storm shelter. <br />Fahey noted the length of time that the City has been working with North <br />Star Estates to get a storm shelter constructed, and the Council's intention <br />to finalize this requirement. <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOI DTION NO. 2004-7-I45 - ~ WARDING THE 1_OW I37D FOR <br />THE NORTI~I STAR ESTATES STORM SHE] TER PROJECT AS <br />RECOMMENDED 13Y CITY STAFF SU73.TECT TO <br />ACKNOWLEDGEMENT 13Y NORTH STAR ESTATES OF THEIR <br />A DTHORIZATION TO PROCEED WIT H THE PRO.IECT AND <br />SUJ3,IECT TO TfIEIR DEPOSIT OF.$Z3,300 <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (5) Blesener, Montow, LaValle, Fahey, Anderson. <br />Nays (0). Resolution declared adopted. <br />CLANDESTINE Fahey noted the sample ordinances submitted by staff relative to <br />DRUG LAB clandestine drug labs which make propeirty owners responsible for the <br />ORDINANCE costs associated with the removal and clean-up necessary from these drug <br />labs. ~l+ahey felt that from a policy standpoint it was good to have an <br />ordinance in place that is similar with those of neighboring cities. <br />Anderson noted that one of his concerns with the sample ordinances is the <br />reference to the definitions contained in State Statute relative to the <br />manufacture of controlled substances. Anderson indicated that these <br />definitions are so broad as to include chemicals that are not hazardous. As <br />a result, Anderson felt that the ordinance exceeds the scope of what the <br />City is trying to do. Anderson stated that his second concern is that the <br />ordinance gives law enforcement the authority to evacuate any building in <br />which they find illegal drugs. Anderson cited the example of law <br />enforcement finding marijuana in one apartment of an apartu~ent building <br />and would thus have the authority to evacuate the entire building <br />displacing many people. <br />Blesener felt that law enforcement would use the appropriate discretion iu <br />enforcing this ordinance. <br />Anderson stated that he hoped so, but pointed out that the situation could <br />be a duplex where law enforcement is not sure of the exact location of <br />illegal drugs. L~ evacuating both units of the duplex, one innocent family <br />could be displaced. Anderson felt the ordinance gave law enforcement the <br />ability to do some things with less evidence rather than having to obtain a <br />
