A%IINUTES <br />CITY COUNCIL <br />JULY 14, 2004 <br />search warrant- Anderson also agreed Yhat there should be a level of <br />conformity in ordinances enacted by neighboring cities. <br />Anderson suggested tying the ordinance to the hazardous chemicals <br />statutes rather than the controlled substance statutes feeling that this would <br />better encapsulate the health risk. Anderson also felt that the ordinance <br />should be modified to place the authority for inspection and declaration of <br />nuisances with a professionally trained position relative to this task, rather <br />than the City's Code Enforcement Officer. <br />Fahey agreed that the position responsible for inspection and declaration <br />of nuisances should be modified, and suggested that the ordinance provide <br />for an authorized City representative. Fahey suggested that with regard to <br />law enforcement's authority, that the City err on the side of caution and <br />assume that law enforcement will act responsibly in enforcing this <br />ordinance. Fahey suggested that the City Attorney and City Administrator <br />use the Vadnais Heights' ordinance as a model, and review it and make <br />recommendations for any changes they feel necessary. Fahey suggested <br />that a review of police powers granted under this ordinance be reviewed to <br />determine if they are over expansive and provide a potential for abuse. <br />Fahey asked that a recommendation be brought to a future Council <br />meeting. <br />TEMPORARY Mr. LaValle introduced the following resolution and moved its adoption: <br />ON-SALE <br />LIQUOR RESOI UTION NO. 2004-7-146 - APPROVING A TEMPORARY <br />LICENSE - ON-SALE LIQUOR LICENSB FOR THE SPORTMEN SOFTBALL. <br />SPORTSMEN C]_UB IN CON.IUNCTION WITH THE MINNESOTA RECREATION <br />SOFTBALL &PARKASSOCIATIONSOFTBAI_7 TOURNAMENT TO BE HELD <br />CLUB IN PIONEER PARK ON AUGUST 73-75, 2004 SUB.IECT TO <br />RECEIPT OF SATISFACTORP LIQUOR LZABII II'Y INSURANCE <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (5) LaValle, Blesener, Fahey, Anderson, Montour. <br />Nays (0). ]3esolution declared adopted. <br />TRAIL BIDS The City Administrator reported that the Park Commission expressed <br />concern with the rejecting of trail bids. As a result, a meeting was held <br />with the Commission Chair, Park Consultant, and City Engineer to review <br />the bids. It was determined that components of the bids were overpriced, <br />and removal of these overpriced items and determination of alternative <br />ways to address these bid components, would result in a more reasonable <br />bid package. <br />
