The City's ordinance currently allows gun sales as <br />an accessory use. <br />Montour noted that at the last meeting the indication was that Mr. <br />I{ennedy's lease was contingent upon necessary approvals from the City. <br />If those approvals are not forthcoming, the impression was that Mr. <br />Kennedy would be able to get out of his lease. <br />Anderson felt that for a city the size of Little Canada it was appropriate to <br />not allow gun sales as a principal use. Anderson also felt that if the Code <br />were amended to allow this use, the City would be faced with the <br />difficulty of enforcing any conditions it would place on gun stores. <br />Anderson pointed out that the City does allow gun sales as an accessory <br />use, therefore, it is not impossible for a business to locate iu Little Canada <br />and sell guns as long as gun sales are accessory to the principal use. <br />Montour agreed with Anderson's comments, and felt that the City's code <br />should remain as is. <br />LaValle stated that he would supporC a Zoning Code amendment allowing <br />gun stores as a principal use. He reported that he discussed the issue with <br />the Mayor who indicated that he would not oppose a zoning change <br />subject to compliance with the recommendations of the Sherifi"s <br />Deparhnent. However, it was noted that it would take four votes of the <br />Council to amend the Zoning Code. <br />LaValle opened the public hearing to consider a request for a <br />Conditional Use Permit to allow a second garage at 315 Savage <br />Lane in addition to the existing attached garage. 'Che Planning <br />Commission recommended approval of the CUP. <br />The Council indicated that they had some questions for the applicant and <br />since he was not present, action would be tabled. Given that the City's 60- <br />day review period will expire prior to the next Council meeting, the City <br />Administrator recommended tabling subject to the execution of a 60-day <br />waiver by Mr. Kurt Adelmann, the applicant.
