M~ivu•rr;s <br />CITY COiJNC1L <br />JULY 28, 2004 <br />Jon Whitcomb, Jon Wesley Investments, appeared before the Council <br />requesting approval of the Gervais Hills Preliminary Plat. Whitcomb <br />noted that the property consists of 5 acres and they are proposing a plat <br />consisting of 12 single-family lots. Whitcomb indicated that the <br />Preliminary Plat meets or exceeds all of the City's code requirements. <br />Whitcomb noted the discussion at the Planning Commission relative to <br />conservation of trees and grades as well as water issues in the County <br />Road B-2 area. Whitcomb noted that after the meeting, he instructed his <br />engineer to make some changes to the plat to accommodate the Planning <br />Commission's recommendations. He further noted that late last week he <br />received a City staff report listing outstanding issues with the plat, and <br />have since met with the City Attorney, City Planner, and City <br />Administrator to discuss the sensitive issues relative to this site. <br />Whitcomb indicated that they are willing to help resolve some of the <br />drainage issues on County Road B-2, but noted that the property is <br />downstream from some of the problems and these existing drainage <br />problems have nothing to do with his submittal. Whitcomb indicated that <br />they have done drainage calculations for the plat and will be creating <br />drainage ponds ou the property to deal with the drainage of the site as well <br />as water coming from Highway 36. These ponds will help with the water <br />coming from the west on County Road B-2. Whitcomb also indicated that <br />they will Yry to save as many of the large trees on the property as they can. <br />LaValle asked if the developer has made application to the Watershed arid, <br />if so, if Watershed approval has been granted. Whitcomb indicated that <br />they have submitted their application. He noted that the City's codes do <br />not require that Watershed approval he granted prior to the City acting on <br />a preliminary plat. Whitcomb noted that the Watershed will review the <br />plat in September. <br />LaValle indicated that the development looks like a good one, and he was <br />confident that the developer would be able to handle the water issues. <br />However, he indicated that he was not comfortable with granting <br />Preliminary Plat approval at this time given Che cumber of outstanding <br />issues and the sensitivity of the area. LaValle indicated that he would be <br />willing to grant concept approval. <br />The City 'Planner indicated that since the Planning Couvnission meeting, <br />the applicant has been working to revise his plans However, there are a <br />number of issues that are outstanding until the Watershed can complete its <br />review. The Planner pointed out that the Watershed has provided some <br />preliminary feedback on the plat, and it is likely that based on the <br />Watershed's comments there will need to be changes made to the plat. <br />The City Planner indicated that given outstanding issues, he would not be <br />comfortable recommending a conditional Preliminary Plat approval and <br />felt it was not in the City's best interests to issue a conditional approval. <br />
