MINUTES <br />CITY COUNCIL <br />JULY 28, 2004 <br />environmentally sensitive area and the impacted property owners. <br />L,aValle stated that if that balance can be found, he would support the plat. <br />Dave Snyder, attorney representing Jon Wesley Investments, pointed out <br />his July 28, 2004 letter sent to the City. Snyder felt that a conditional <br />Preliminary Plat approval could be granted for Gervais Hills. That <br />conditional approval could incorporate the recommendations of the <br />Watershed and City staff, and Final Plat would then have to be modified <br />accordingly- Snyder indicated that they a<~e willing to work with the <br />Watershed relative to any recommendations that they have. Snyder <br />suggested that an interim development agreement could be executed <br />between the City and developer which memorialize the conditions of <br />Preliminary Plat approval. Snyder suggested that a conditional <br />Preliminary Plat approval this evening would be a step forward, but noted <br />that the Preliminary Flat as submitted meets all the conditions of the City's <br />ordinances. Snyder indicated that the developer wants to work with the <br />City, and understands that based on the Watershed's recommendation the <br />plat may have to be modified. Snyder indicated that the Final Plat will <br />reflect all the conditions oFPreliminary Plat approval. <br />LaValle indicated that he prefers to err on the side of caution, and <br />indicated that he was not comfortable with a conditional Preliminary Plat <br />approval at this point. LaValle noted that he is interested in seeing the <br />property developed and the increase to the City's tax base. However, he <br />felt that delaying the Preliminary Plat approval al this point was <br />appropriate given the outstanding issues and the need for Watershed <br />review and comment. <br />Snyder felt that a conditional Preliminary Plat approval would protect the <br />City. He again noted that the Final Plat that would be brought back would <br />reflect all conditions of Preliminary Plat approval. Snyder suggested that <br />as an alternative to waiting until the Watershed's approval iu September, <br />that they come back in August with a Preliminary Plat that reflects as <br />many of the conditions listed in the July 21~` memo as possible. Snyder's <br />concen~ was that in waiting until September, action on the Final Plat is <br />pushed offfor another mouth. <br />Blesener asked why the Watershed's review was not until September. <br />Snyder replied that that was the earliest they could get the plat on the <br />Watershed's agenda. Snyder also pointed out the recommendations in the <br />July 2l~' letter that require seeding and plantings around the ponding areas <br />to be established. Snyder indicated that the earlier they can begin grading, <br />the earlier they can get this seeding and plantings established. <br />Blesener noted that the Watershed's recommendation may have some <br />influence on where the ponds and house pads can be located. <br />9 <br />
