MINUTES <br />CITY COUNCIL <br />AUGUST 25, 2004 <br />FIRE RELIEF It was the consensus of the Council to hold a Little Canada ,Fire Relief <br />MEETING meeting on Tuesday, September 7, 2004 at 6:00 p.m. at the Little Canada <br />Fire Hall. <br />HIDDEN Kim Walstead, 150 Yorkton Ridge, appeared before the Council relative <br />ACRES to construction of the pond that is part of the Hidden Acres development. <br />Walstead reported that on August 14°i the City Administrator responded to <br />a call from the Sheriff's Department relative to pond construction. <br />Walstead reported that the Administrator then met on site with him, his <br />wife, his attorney, and neighbor Matt White, and the Administrator agreed <br />to prepare a letter wherein the City would indemnify the Walstead's for <br />any damage to their property caused by the construction of the pond. The <br />Administrator indicated that he would present that letter to the Council for <br />approval. <br />The City Administrator responded That at no time did he say he would <br />prepare a letter on behalf of the City indemnifying the Walstead's. <br />Fahey noted that the City is accowrtable for and responsible for the <br />appropriate development and engineering for the Hidden Acres project. <br />He indicated that he is confident that the project is being developed in <br />accordance with appropriate engineering standards. However, the City <br />will not guarantee or indemnify the Walstead's as Mr. Walstead has <br />suggested. Fahey asked Mr. Walstead if he had any specific issues other <br />than that one that he would like to discuss. Fahey noted that the Hidden <br />Acres development is in the beginning stages of construction, and he <br />suggested that the City was not going to nitpick the project. Fahey <br />suggested that if the Walstead's have any project concerns, that he was <br />confident that the City Engineer and City Administrator would address <br />those concerns in a reasonable manner, but noted that there is a reasonable <br />range of what the City will do. Fahey again stated that the City does not <br />indemnify people. However, the City will ensure that the project is <br />constructed properly from an overall engineering standpoint. <br />Walstead reported of a meeting that he had with the Watershed at which a <br />Watershed engineer indicated that they would never have approved the <br />Hidden Acres pond in the location it is being constructed had they visited <br />the site first. Walstead noted that construction on the pond began prior to <br />issuance of the Watershed permit. <br />The City Administrator indicated that the Watershed had not yet issued its <br />permit on the date of the meeting that Mr. Walstead is talking about since <br />they were waiting for some additional calculations. The Administrator <br />indicated that the (:ity Engineer had already received those calculations. <br />17 <br />
