MINUTES <br />CITY COUNCIL <br />SEPTEMBER 22, 2004 <br />RESOLUTION NQ 2004-9-22] -APPROVING TIIE DIVISION OF <br />4G9 I A13ORE ROAD INTO THREE SING] E FAMII Y LOTS AS <br />REQUESTED 73Y GREG STf1 RK .SU73.IECT TO COMPLIANCE WITH <br />THE RECOMMENDATIONS OF TIIE CITY PLANNER AS <br />OUTLINED IN HIS b'EPTEM73ER 1, 2004 REPORT <br />The foregoing resolution was duly seconded by Fahey. <br />Ayes (5) Montour, Fahey, Allan, Blesener, LaValle. <br />Nays (0). Resolution declared adopted. <br />AMENDMENT Fahey opened the Public Hearing to consider the request for an <br />TO CUP - Amendment to Conditional Use Permit expanding outdoor storage area <br />3173-3175-3177 as well as a Variance to encroach into the required side yard setback for <br />SPRUCE STREET- property at 3173-3175-3177 Spruce Street as requested by Rick Igo. <br />RICK IGO The City Planner and the Planning Commission have recommended <br /> approval of the CUP Amendment. <br />Blesener indicated that he viewed the property and the applicant has made <br />a great deal of improvement at the site. Igo indicated that he leases the <br />building to three small businesses. Given that these businesses could <br />turnover, he is requested flexibility with the outdoor storage so that the <br />types of materials stored can change depending on the business that is <br />located on the property. ]go felt that this flexibility would allow the <br />property to stay within the City's Code requirements and simplif es <br />storage issues. <br />Blesener pointed out that the CUP runs with the land and asked if <br />eliminating the specific identif cation of storage materials would create <br />problems if ownership of the property changes. The City Planner noted <br />that the outdoor storage area would be limited fo a specific location and <br />would have to be screened firom the street. Blesener noted the discussion <br />at the Planning Commission meeting about the lack of screening at the <br />driveway areas. The Planner replied that the screened fencing at the drive <br />areas is not needed at this time as the outdoor storage is screened without <br />this fencing. <br />The Council discussed enforcement of CUP conditions, and Fahey noted <br />that the Council can revoke a CUP if conditions are violated. <br />LaValle commended Igo on the appearance of his property. LaValle <br />asked if the materials that the auto body business has inside the building <br />would be moved to the outside. Igo replied that this would not occur and <br />noted that he has specific conditions in his leases relative to outdoor <br />storage. All small pares that are allowed to be stored outside must be <br />palletized or on a trailer. <br />5 <br />
