MINUTES <br />CITY COUNCIL <br />OCTOBER 13, 2004 <br />WATERSIED <br />PURCHASE <br />AGREEMENT <br />TOR NOEL <br />DRIVE <br />PROPI•;RTY <br />The foregoing resolution was duly seconded by Allan. <br />Ayes (5) B(esener, Allan, LaValle, Fahey, Montour. <br />Nays(0). Resolution declared adopted. <br />1n continuing discussion on the issue of the woodburning stove, ~Blesener <br />indicated that he has a problem with an extremely high chimney for this <br />stove also noting the guy wires that would be necessary for the chimney. <br />Bruhn asked that Precision Tree be allowed to test the stove relative to <br />determining what is necessary to meet PCA standards. The Council was <br />agreeable to allowing cone-week period for testing. Council asked that <br />the City Staff be informed when testing will occur indicating that they <br />may want to visit the site to observe the testing and determine the extent of <br />the nuisance that odor emissions are causing for the area. <br />Fahey reviewed the City Administrator's recommendation for <br />approval of the Watershed Purchase Agreement for the City's <br />Noel Drive Property. He also noted the request of the Parks & <br />Recreation Commission Chair to }>ostpone action on the Purchase <br />Agreement as well as the request of a Noel Drive property owner <br />to postpone this action. Fahey stated that it was his feeling that the <br />conditions included in the Purchase Agreement were adequate to protect <br />the City. <br />Montour suggested that the appraisal of the property occur first, and once <br />the value of the property is determined, the City should then proceed with <br />the Purchase Agreement. <br />Cliff Aichinger, Ramsey Washington Metro Watershed District, noted that <br />the proposed purchase agreement would be contingent upon the buyer's <br />acceptance of the selling price. Fahey suggested that if the appraised <br />value appears too low, the City should have the ability to withdraw from <br />the purchase agreement. The City Administrator noted that the City will <br />be selecting the appraiser. <br />LaValle asked if the Watershed was comfortable with the conditions as <br />outlined in the Purchase Agreement. Aichinger indicated that the <br />Watershed's attorney has some concerns with some of the provisions, <br />feeling they are not appropriate to be included in a Purchase Agreement. <br />Aichinger requested that the City's approval of the Agreement be <br />contingent upon the City Attorney and Watershed attorney negotiating <br />some of these details. <br />
