MINUTES <br />CITY COUNCIL <br />OCT0I3ER l3, 2004 <br />Fahey felt that the concerns raised by the Parks & Recreation Commission <br />Chair did not provide for a reasonable basis to delay moving forward with <br />the Purchase Agreement. Fahey stated that he did not want negotiation <br />between of the attorneys of any provisions that were of a substantive basis. <br />Kathy Glanzer, Noel Drive resident, requested that the City postpone <br />action on the Purchase Agreement until after the public hearing on the <br />Conditional Use Permit that will be necessary for the Watershed project. <br />Glanzer suggested that holding the public hearing prior to executing a <br />Purchase Agreement, as initially agreed to by the City and the Watershed <br />District, would seem to provide for more participation by the Noel Drive <br />neighborhood in the process. Glanzer expressed concern that concept <br />plans submitted to date include the need for variances and have shown on- <br />street parking. <br />Aichinger indicated that the Watershed is planning a $2 million project <br />and will begin the process of developing plans with the architect they just <br />hired. Aichinger reported that the Watershed has informed the architect <br />that they must be able to develop the site without variances, or they will <br />not pay the architect. Aichinger indicated that the Watershed is asking the <br />City to enter into a Pm'chase Agreement at this time because they would <br />like assurances that they will be able to buy the property. The Watershed <br />attorney, however, does have some concerns with a few of the provisions <br />that have been included in the Purchase Agreement. Aichinger stated that <br />the Watershed is aware they must meet zoning requirements, and knows it <br />can fit a building ou the site without the need for variances. Aichinger <br />also reported that they are currently in negotiations with Norm's Tires to <br />pm~chase 20 feet of property to add to the Noel 'Drive site. <br />Glanzer requested that given the Watershed's concerns with some of the <br />provisions in the Purchase Agreement, that the Council not act on the <br />Pw~chase Agreement until it sees a final draft that includes the changes the <br />Watershed attorney is seeking. Glanzer noted that the City Administrator <br />has done a good job of incorporating the conditions listed in the Letter of <br />Understanding in the Purchase Agreement, and she was concerned that it <br />was these conditions that the Watershed wished removed. <br />The Parks & iteereation Director indicated that the Parlcs & Recreation <br />Commission would like to see a concept of the building and how it will fit <br />on the site. The Commission is not asking to see final I>lans prior to <br />entering into the Purchase Agreement. The Director noted the close <br />proximity of the Noel Drive property to the City's park system and trails <br />and would like input on the development of building and site plans prior to <br />finalization. The Director indicated that the Conunission feels that the <br />Watershed's use is likely a good fit for the area, but would like more input <br />on the front end of this project. <br />
