MINUTB,S <br />CITY COUNCIL <br />NOVEM,B;C,R 10, 2004 <br />The City Administrator further noted the City's previous actions on these <br />violations over the past eleven years, which include civil penalties ranging <br />up to $100 with suspension of the penalty provided there are no <br />subsequent violations for one year. <br />Fahey indicated that he will be abstaining from discussion and action on <br />these violations. <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOI, UTION NO. 200a-T I-275 -IMPOSING ~] X200 CIVIL <br />PENAL T I' ON BOTH T/EI2NEY',4 LIQUORS AND D1OON ]3AY <br />1.1QUORS FOR LIQUOR ORDINANCE VIOLATION, AND <br />S(ISPENDING THAT PENAL TYIF THERE ARE NO SUB.SEQ(IF.NT <br />VIOLATIONS FOR A PERIOD OI' ONE YEAR <br />The foregoing resolution was duly seconded by Allan. <br />Ayes (3) Blesener, Allan, Montour. <br />Nays (0). <br />Abstains (])Fahey. Resolution declared adopted. <br />COUNCIL The City Administrator reviewed in detail his report dated <br />VACANCY November 5, 2004 outlining the options for filling the Council <br />PROCESS vacancy that will occur at the time Council Member Blesener assumes the <br />duties of Mayor in 2005. These options include either a special election a' <br />appointment to fill the vacancy. <br />Blesener noted that during his first teen on the Council, there was a <br />Council vacancy that will filled through an appointment process. Flesener <br />stated that he supported filling this vacancy through an appointnent <br />process as well. He suggested that the vacancy be advertised, interested <br />citizens submit a letter of interest explaining their qualifications as well as <br />the reasons they are seeking the office. Blesener suggested that <br />applications be taken up until the December 15°i Council meeting. At that <br />meeting, depending on the number of applications received, the Council <br />can decide on the mechanics of the interview process. Blesener suggested <br />that a special meeting could be held on January 5, 2005 to conduct <br />interviews and vote on the appointment It was noted that appointment <br />would be by a majority vote of the Council. In the case of a tie vote, the <br />Mayor would make the appointment. <br />It was the consensus of the Council that the vacancy would be filled <br />through an appointment process. It was also the consensus of the Council <br />that applications would be taken for the Council vacancy up until <br />December 14, 2004 at 4:30 p.m. <br />
