MINUTES <br />CITY COUNCIL <br />DECEMBER 15, 2004 <br />Mayor Fahey acknowledged the deputies hard work in solving this <br />homicide, and applauded their efforts and laborious work Mayor Fahey <br />presented each with a Certificate of Appreciation on behalf of the City. <br />Commander Altendorfer also thanked Ramsey County Assistant Attorney <br />Robert Plesha for his work in handling The case at trial. <br />VARIANCE & Mayor .Fahey opened the Public Hearing relative to the request for a <br />ARCI~ITF,C- Variance to exceed the mm~ber of wall signs allowed as well as <br />TURAL Architectural .Review of the proposed signage for 3006 Rice Street, <br />REVIEW - A & W. It was noted that the Planning Commission recommended <br />3006 RICE denial of the Variance given there is no hardship to warrant a. <br />STREET - variance, and recommended approval of the Architectural Review for <br />A & W any building improvements provided those improvements meet the <br />recommendations of the City Planner and all Code requirements. <br />There was no one from the general public present wishing to comment on <br />this matter. <br />Upon motion by Blesener, seconded by Montour, the public hearing was <br />closed. <br />Council noted that the applicant, Mr. Patrick Nickelson, has submitted a <br />letter withdrawing his request for Variance and Architectural Review. It <br />was also noted that Mr. Nickelson has requested a refund of the deposit <br />associated with these applications. It was the consensus of the Council to <br />not vary from City practice and refwid only those unspent application <br />dollars. <br />The City Attorney indicated that given the withdrawal request, the <br />appropriate action of the Council would be to accept that request. <br />Ivlr. Resolution declared adopted. <br />
