MINUTKS <br />PLANNING COMMISSION <br />JULY 10, 2008 <br />and vegetation, whether fencing would be installed, and when construction <br />would begin on the new house. The Planner indicated that the two B-2 <br />homes would remain, the new lot would be sold, but there are no house <br />plans available at this time. Construction would occur once the lot is sold <br />and the new owners are ready to construct a house. The Planner also <br />indicated that given this property is not required to be platted, the tree <br />preservation ordinance does not apply. However, the lot would be restricted <br />to a maximum impervious surface of 35%. <br />Melinda Stone, 598 County Road B-2, asked about the impact on property <br />values as well as existing trees and vegetation. She noted that the <br />backyards abut and there is a significant amount of green growth. Stone <br />also noted that the sewer line that will be run through is adjacent to her lot <br />and asked about this impact. Knudsen pointed out that the sewer line will <br />be run through the LaVaque property and that work cannot encroach into <br />her yard. Kurth reported that the sewer line is being jogged so as to <br />preserve some existing pine trees. Kurth reported that the majority of the <br />trees on the proposed lot are near Viking Drive. Kurth anticipated that the <br />new owners will save as many trees as possible. He also pointed out that <br />there will be a 40 foot rear yard setback, therefore, trees should be saved in <br />the back yard. <br />Lisa Douglas, 615 Viking Drive, asked the proposed house size. The City <br />Planner indicated that a house has not been designed for this lot as yet, but <br />there will be a building pad of approximately 3,500 square feet. Douglas <br />stated that she had no objection to the proposed new lot. <br />Duray asked if the house design will be presented to the Commission for <br />approval. The City Planner replied that as long as Codes are being met, the <br />house design will be submitted to the Building Official for building permit <br />processing. Duray asked about tree preservation. The Planner indicated <br />that a simple lot split does not require compliance with the tree preservation <br />ordinance. Knudsen stated that it appeared many of the trees are not within <br />the building pad area. The Planner noted that grading contractors can be <br />fairly aggressive. He stated that hopefully the new buyer will value the <br />trees and take steps to preserve them. <br />Mr. Duray recommended approval of the Property Division subdividing 580 <br />and 588 County Road B-2 into three single-family lots as proposed by Mr. <br />Gene LaVaque subject to compliance with the recommendations of the City <br />Planner as outlined in his report dated July 3, 2008, subject to compliance <br />with the recommendations of the City Engineer as outlined in his report <br />dated July 1, 2008, and subject to finalization of an encroachment <br />agreement with Magellan Pipeline. <br />Motion seconded by Knudsen <br />-5- <br />
